Subject/Title: Approve a Resolution accepting the work performed by Antioch Paving Company, Inc. for the construction of the Second Street Parking Lot, CIP Project No. 336-3135.

RECOMMENDATION
Approve a Resolution accepting the work performed by Antioch Paving Company, Inc. for the construction of the Second Street Parking Lot, CIP Project No. 336-3135, and directing the City Clerk to file a Notice of Completion with the County Recorder.

PREVIOUS ACTION
On May 28, 2002, the City Council approved and adopted the 2002/07 Capital Improvement Program for the City, of which the Second Street Parking Lot, CIP Project No. 336-3125, is a part, and was budgeted for $60,000.
On November 12, 2002, the City Council awarded a contract in the amount of $45,462.50 plus a 10% contingency to Antioch Paving Company, Inc. to construct the Second Street Parking Lot, CIP Project No. 336-3135.
This project was funded in full by the Redevelopment Agency, by its Resolution No. RA-63, on November 12, 2002, in the amount of $45,462.50 plus a 10% contingency ($50,008.75).

On September 9, 2003, the City Council approved a change order in the amount of $6,000 in order to install bike racks and additional safety lighting.

On September 9, 2003, the Redevelopment Agency, by its Resolution No. RA-75 funded the approved change order in the amount of $6,000.

BACKGROUND
As part of the City’s desire to make more parking available around City Hall and the downtown business area, staff explored and evaluated different alternatives. Just over the last year, the City has constructed two parking lots in the downtown area; both funded by the Redevelopment Agency. Continuing the efforts to improve parking availability, the City leased the subject property from a private property owner, and by paving this lot and adding lighting, has added an additional highly-desirable 52 parking spaces to the downtown business area, reducing parking congestion around City Hall and the downtown area. This parking lot is providing major relief at a minimal expenditure, until a permanent downtown parking garage structure or some other alternative becomes available.

The contractor has met all the contractual requirements to accept the work. This acceptance by the City Council is an administrative action necessary to formally close the project.

FISCAL IMPACT
The $60,000 budget for this project is accounted for in the approved CIP Budget 2002/03.

The original construction contract for this project was $45,462.50, with a 10% contingency of $4,546.25, to a total of $50,008.75.

During the construction stage, we found two abandoned oil caps below grade, in the back of the old trailer site. For additional precaution, we hired a consultant to perform an asbestos report. The original contingency of $4,546.25 was used to cover the above improvements. The new subtotal was $50,008.75. City staff added the amended CIP Sheet into the 2003/04 CIP Budget book, which reflects this budget modification.

On September 9, 2003, the City Council authorized additional contingency funds, in the amount of $6,000, to install bike racks and additional safety lighting. Change orders to the contract totaled $10,546.25 (23% of the original contract price) for a final contract price of $56,008.75.

This project was fully funded by the Redevelopment Agency.

The annual cost for leasing - $12,000, and the annual cost for maintenance - $6,000, will be funded by the City’s General Fund.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO ACCEPT THE WORK PERFORMED BY ANTIOCH PAVING COMPANY, INC. FOR THE SECOND STREET PARKING LOT, CIP PROJECT NO. 336-3135.

WHEREAS, on May 28, 2002, the City Council approved and adopted the 2002/07 Capital Improvement Program for the City, of which the Second Street Parking Lot, CIP Project No. 336-3125, is a part; and

WHEREAS, on November 12, 2002, the City Council awarded a contract in the amount of $45,462.50 to Antioch Paving Company, Inc. to construct the Second Street Parking Lot, CIP Project No. 336-3135; and

WHEREAS, on September 9, 2003, the City Council approved a change order in the amount of $6,000 in order to install bike racks and additional safety lighting.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood that the Second Street Parking Lot, CIP Project No. 336-3135, is hereby accepted.

BE IT FURTHER RESOLVED that the City Clerk is hereby directed to file a Notice of Completion with the County Recorder for the project.

NOTICE OF COMPLETION

NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did, on November 12, 2002, enter into an agreement with Antioch Paving Company, Inc. for the construction of the Second Street Parking Lot, CIP Project No. 336-3135; located on the corner of Second and Oak Streets, Brentwood, California.

The work described in the contract documents was to furnish all material, labor, and equipment necessary to complete the said project.

On October 14, 2003, the said contract, as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
