Subject/Title: Approve a Resolution for the acceptance of Improvements for Deer Ridge Country Club Village B-1-B, KB Home, Subdivision No. 8479

RECOMMENDATION
Approve a Resolution accepting the offers of dedications for the right-of-way of Troon Drive and Bayonette Court for public use as shown on the Final Map; accepting the offers of dedication for all the easements, abutter’s rights, sub-surface water rights and accepting all on-site public improvements (waterlines, sanitary sewer, storm drain, fiber optics, and streets with all related improvements) for maintenance; accepting the Subdivision Maintenance Bonds and releasing the Subdivision Improvement Securities for Deer Ridge Country Club Village B-1-B, KB Home, Subdivision No. 8479, located south of Balfour Road and on Saint Andrews Drive.

PREVIOUS ACTION
On January 19, 1993, the Planning Commission of the City of Brentwood approved Resolution No. 93-2, approving the Vesting Tentative Map of Subdivision No. 7690, SunCal, with conditions.

On January 12, 1999, the City Council approved Resolution No. 99-18, approving the Final Map of Subdivision No. 7690 with improvement securities and a Subdivision Improvement Agreement.

On March 26, 2002, the City Council approved Resolution No. 2494 approving the Final Map of Subdivision No. 8479 with improvement securities and the Subdivision Improvement Agreement.

BACKGROUND
The Final Map is a portion of the SunCal development and is located on the south side of Balfour Road and west of Concord Avenue, on Saint Andrews Drive, and was recorded on May 17, 2002, in Book 442 of Maps, at Page 29, Contra Costa County Records. The subdivision contains 53 single-family residential lots. All the public improvements for this subdivision have been constructed and inspected by the City inspector. In conjunction with the Final Map, the Developer provided improvement securities (Performance and Payment Bonds) for these improvements. A final inspection of these improvements found them to be complete and in conformance with the approved improvement plans.

Following are the major improvement quantities installed: 1,290 LF of sanitary sewer lines, 1,290 LF of waterlines, 620 LF of storm drain lines, 2,580 LF of sidewalk, 2,580 LF of curb and gutter, 43,570 SF of pavement, and 7 streetlights. A final inspection of these improvements found them to be complete and in conformance with the approved improvement plans.

The parcels were offered for dedication on the Final Map. When the Final Map was approved by the City Council, the offers of dedication were accepted subject to acceptance of improvements. Now that the parcels are improved, the City must accept the improvements in order to obtain rights to the parcels offered on the Final Map. The Developer of Subdivision No. 8479, KB Home, has already provided a Maintenance Bond (Bond No. 400SF2160-02 in the amount of $46,113) to cover the twelve-month warranty period for the on-site improvements.

FISCAL IMPACT
After the acceptance of improvements, the City will then incur costs in the amount of $6,500 for on-site improvements associated with street sweeping and necessary repairs to streets and utilities. Regular roadway maintenance will be funded by the General Fund, Measure “C”, gas tax, and sewer and water maintenance will be funded through respective enterprise funds. The Lighting and Assessment Maintenance District (LLD 99-5) has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION FOR STREET RIGHT OF WAY, FOR ALL PARCELS AND EASEMENTS FOR PUBLIC USE AS SHOWN ON THE FINAL MAP, ACCEPTING THE PUBLIC IMPROVEMENTS (WATER, SANITARY SEWER, STORM DRAIN, FIBER OPTICS AND STREETS WITH ALL RELATED IMPROVEMENTS) FOR MAINTENANCE, ACCEPTING THE SUBDIVISION MAINTENANCE BONDS, AND RELEASING THE SUBDIVISION PERFORMANCE AND PAYMENT BONDS FOR DEER RIDGE COUNTRY CLUB VILLAGE B-1-B, KB HOME, SUBDIVISION NO. 8479, LOCATED SOUTH OF BALFOUR ROAD AND WEST OF CONCORD AVENUE

WHEREAS, on January 19, 1993, the Planning Commission of the City of Brentwood approved Resolution No. 93-2, approving the Vesting Tentative Map of Subdivision No. 7690, SunCal, with conditions; and

WHEREAS, on January 12, 1999, the City Council approved Resolution No. 99-18, approving the Final Map of Subdivision No. 7690 with improvement securities and a Subdivision Improvement Agreement; and

WHEREAS, on March 26, 2002, the City Council approved Resolution No. 2494, approving the Final Map of Subdivision No. 8479 with improvement securities and a Subdivision Improvement Agreement; and

WHEREAS, the required public improvements have been completed and are in conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements (waterlines, sanitary sewer, storm drain, fiber optics and streets with all related improvements) are hereby accepted for maintenance, and the offer of dedications for public use of all the streets and parcels as offered for dedication on the Final Map are hereby accepted.

BE IT FURTHER RESOLVED that the Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.

BE IT FURTHER RESOLVED that the offers of dedications in fee are hereby accepted for right-of-way of Troon Drive and Bayonette Court, and that the offers of dedication are hereby accepted for all easements as shown on the Final Map of Subdivision No. 8479.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements are hereby accepted.

BE IT FURTHER RESOLVED that the City Council of the City of Brentwood hereby authorizes the City Clerk to file this Resolution with the Recorder of Contra Costa County.
