Subject/Title: Acceptance of Improvements for Harvest Glen, Standard Pacific, Subdivision No. 8462

Submitted by: Engineering: B. Grewal/E. Kim/D. Boskovic

RECOMMENDATION
Approve a Resolution accepting the offers of dedication for the rights-of-way of Buckingham Drive, Fairview Avenue, Chatsworth Court, York Court, and Clay Court for public use as shown on the Final Map; accepting the offers of dedication for all the easements, abutter’s rights, sub-surface water rights, and accepting all on-site public improvements (waterlines, sanitary sewer, storm drain, fiber optics, and streets with all related improvements) for maintenance; accepting the Subdivision Maintenance Bonds and releasing the Subdivision Improvement Securities for Harvest Glen, Standard Pacific Corporation, Subdivision No. 8462, located south of Balfour Road (south of the new Safeway site) and east of Fairview Avenue.

PREVIOUS ACTION
On February 17, 1987, the Planning Commission approved Resolution No 87-5, approving the Tentative Map of Subdivision No. 8462, Standard Pacific Corporation, with conditions.

On March 27, 2001, the City Council approved Resolution No. 2257, approving the Final Map of Subdivision No. 8462 with improvement securities and a Subdivision Improvement Agreement.

On January 30, 2001, the Planning Commission approved Resolution No 01-05, approving the Design Review of Subdivision No. 8462, Standard Pacific Corporation, with conditions.

BACKGROUND
The Final Map is located on the south side of Balfour Road and east of Fairview Avenue, and was recorded on May 16, 2001, in Book 430 of Maps, at Page 26, Contra Costa County Records. The subdivision contains 37 single-family residential lots. All the public improvements for this subdivision had been constructed and accepted by the City Council. In conjunction with the Final Map, the Developer provided improvement securities (Performance and Payment Bonds) for these improvements. A final inspection of these improvements found them to be complete and in conformance with the approved improvement plans.

Following are the major improvement quantities installed: 1,170 L.F. of sanitary sewer lines, 1,343 L.F. of waterlines, 1,153 L.F. of storm drain lines, 3,166 L.F. of sidewalk, 3,150 L.F. of curb and gutter, 50,970 S.F. of pavement, and 11 streetlights. A final inspection of these improvements found them to be complete and in conformance with the approved improvement plans.

The parcels were offered for dedication on the Final Map. When the Final Map was approved by the City Council, the offers of dedication were accepted subject to acceptance of improvements. Now that the parcels are improved, the City must accept the improvements in order to obtain rights to the parcels offered on the Final Map. The Developer of Subdivision No. 8462, Standard Pacific Corporation, has provided a Maintenance Bond (Bond No. 11119521786M in the amount of $85,800.00) to cover the twelve-month warranty period for the on-site improvements.

FISCAL IMPACT
After the acceptance of improvements, the City will then incur annual costs in the amount of approximately $5,000 for on-site improvements associated with street sweeping and necessary repairs to streets and utilities. Regular roadway maintenance will be funded by the general fund, Measure “C”, gas tax, and sewer and water maintenance will be funded through respective enterprise funds. The Lighting and Assessment Maintenance District (LLD 94-1S) has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.
