RECOMMENDATION
Approve a Resolution authorizing the City Manager execute a contract amendment with Vali Cooper & Associates, Inc. for Engineering and Parks and Recreation Inspection Services for new development and Capital Improvement Projects in the amount of $122,558.40, and authorize the City Manager to approve change orders up to 10% of the contract amount.

PREVIOUS ACTION
On April 22, 2003, the City Council approved a Resolution authorizing the City Manager to enter into a Professional Services Agreement with Vali Cooper & Associates, Inc. for Engineering Inspection Services for new development and Capital Improvement Projects (CIP) in the amount of $122,558.40, and authorize the City Manager to approve change orders up to 10% of the contract amount.

BACKGROUND
The City of Brentwood has experienced an enormous amount of residential and commercial development in the last few years. The number of roadway, utility, parks, and landscaping infrastructure projects created by new development and the City’s Capital Improvement Projects (CIP) continue to increase. Presently, the Engineering and Parks and Recreation Inspectors are having a difficult time in keeping up with the increased inspection demands for improvements. Inspection services are an integral part of the construction process for quality control and to verify that all improvements are constructed in conformance with City and State standards. Having good quality control during construction reduces maintenance costs and is also less inconvenient to the public.

The Engineering Department is presently in the process of hiring a full time inspector (replacement position), so the Engineering portion of this agreement will provide inspection services until a new inspector is hired. Thereafter, on-call services will be available, if necessary.

The Parks and Recreation Department with the addition of the Sunset Park Expansion and Balfour Park (adjacent to the Aquatic Center) require an on-call landscaping inspector. The additional inspection services will require approximately 20 hours per week over the next six (6) months.

Vali Cooper & Associates, Inc. has nearly 20 years of project management and inspection experience on roadway, highway, utility, parks, and landscaping projects and will be of great assistance to our present staff of Engineering and Parks and Recreation Inspectors.

FISCAL IMPACT
The funding for the Engineering Inspection portion of the agreement (65,558.40) is from the developer inspections account.

The funding for the Parks and Recreation Inspection portion of the agreement ($57,000) is from Development Fees (Quimby Fees).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT AMENDMENT WITH VALI COOPER & ASSOCIATES, INC. FOR ENGINEERING AND PARKS AND RECREATION INSPECTION SERVICES FOR NEW DEVELOPMENT AND CAPITAL IMPROVEMENT PROJECTS (CIP) IN THE AMOUNT OF $122,558.40; AND AUTHORIZE THE CITY MANAGER TO APPROVE CHANGE ORDERS UP TO 10% OF THE CONTRACT AMOUNT.

WHEREAS, the City of Brentwood has experienced an enormous amount of growth in the last few years and the number of roadway, utility, park, and landscaping infrastructure projects created by new development and the Capital Improvement Projects (CIP) continue to increase; and

WHEREAS, the Engineering and Parks and Recreation Inspectors are having a difficult time in keeping up with the increased inspection demands for improvements constructed; and

WHEREAS, inspection services are an integral part of the construction process to verify that all improvements are constructed in conformance with City, State, and Federal standards and specifications; and

WHEREAS, Vali Cooper has provided inspection services for nearly 20 years of project management experience on roadway, highway, utility, parks, and landscaping projects.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby authorize the City Manager to execute a contract amendment with Vali Cooper & Associates, Inc. for Engineering and Parks and Recreation Inspection Services for new development and Capital Improvement Projects (CIP) in the amount of $122,558.40; and authorize the City Manger to approve change orders up to 10% of the contract amount.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting on the 28th day of August 2003 by the following vote:

AMENDMENT ONE
TO
AGREEMENT FOR PROFESSIONAL SERVICES
OF VALI COOPER & ASSOCIATES, INC.

This Amendment is entered into on August 26, 2003 by and between the City of Brentwood and Vali Cooper & Associates, Inc.

WHEREAS, on April 22, 2003, the City of Brentwood entered into a contract to obtain specific skills and technical expertise for professional construction inspection services on an as needed basis for Citywide projects.

NOW, THEREFORE, IT IS AGREED as follows:

1. Section 4, of the original contract, entitled termination is amended to change the stated termination date of the contract from October 31, 2003 to April 30, 2004.

2. Section 5, of the original contract, entitle payment shall be revised to include a change order in the amount of $122,558.40 to complete the work plus 10% contingency for unknowns.

3. All other terms remain unchanged.
