Subject/Title: Approve Joint Exercise of Powers Agreement between the City of Brentwood, Contra Costa County, East County Transportation Improvement Authority and the State Route Bypass Authority to Construct Intersection Improvements at the intersection of Vasco Road and Camino Diablo, CIP Project No. 336-3105.

RECOMMENDATION
Approve a Resolution approving a Joint Exercise of Powers Agreement (JEPA) between the City of Brentwood, Contra Costa County (County), East County Transportation Improvement Authority (ECTIA) and the State Route Bypass Authority (Authority) to construct intersection improvements at the intersection of Vasco Road and Camino Diablo, CIP Project No. 336-3105 and authorizing the City Manager to execute the agreement.

PREVIOUS ACTION
On May 27, 2003, the City Council passed Resolution No. 2868 adopting the 2003/04 – 2007/08 Capital Improvement Program budget, which included Vasco/Camino Diablo Intersection Improvements, CIP Project No. 336-3105.

BACKGROUND
Vasco Road and Camino Diablo are highly traveled roads that many residents from East Contra Costa County residents use to travel to and from Silicon Valley and tri-valley areas. With the growth in the East Contra Costa County, the demand placed on the existing improvements at the intersection of Vasco Road and Camino Diablo has increased tremendously. The City of Brentwood in collaboration with the County, ECTIA and the By Pass Authority have planned the improvements of this intersection.

The improvements include, but are not limited to, widening of Vasco Road to accommodate an additional through lane, minor pavement widening on Camino Diablo to accommodate the proposed protected left turn lanes, traffic signal modifications and minor drainage improvements.

This project is out for construction bid and construction is anticipated to start in late summer of this year.

This four-party agreement identifies the responsibilities of each party and their financial obligation for the construction of the intersection improvements.

The City of Brentwood will contribute $200,000 of the $2.1Million estimated total project costs. Item 3F in the attached JEPA implies that all parties shall contribute additional funds if the actual construction costs exceed the estimate. Contra Costa County provided a clarifying letter, per our request, stating that there will be no additional funds contributed by the City of Brentwood.

FISCAL IMPACT
The funding to be contributed by the City is in accordance with the adopted 2003/04 – 2007/08 Capital Improvement Program, CIP Project No. 336-3105. The City will incur no additional costs. Maintenance of the improvements will be the responsibility of Contra Costa County.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING JOINT EXERCISE OF POWERS AGREEMENT BETWEEN THE CITY OF BRENTWOOD, CONTRA COSTA COUNTY, EAST COUNTY TRANSPORTATION IMPROVEMENT AUTHORITY AND THE STATE ROUTE BYPASS AUTHORITY TO CONSTRUCT INTERSECTION IMPROVEMENTS AT THE INTERSECTION OF VASCO ROAD AND CAMINO DIABLO (CIP 336-3105)

WHEREAS, the Circulation Element of the General Plan establishes the need to provide a transportation system that maintains and enhances the livability of the City; and

WHEREAS, Policy 3.1 of the General Plan states the goal of integrating the transportation system to improve circulation in locations with high levels of congestion; and

WHEREAS, Item 10 of the Summary of Implementation Mechanisms of the General Plan requires participation in efforts to expand the regional transportation system, and

WHEREAS, Vasco Road and Camino Diablo are highly traveled roadways that currently cause significant delays for Brentwood residents commuting to and from southern Alameda and San Joaquin counties; and

WHEREAS, on May 27, 2003, the City Council passed Resolution No. 2868 adopting the 2003/04 – 2007/08 Capital Improvement Program budget, which included Vasco/Camino Diablo Intersection Improvements, CIP Project No. 336-3105; and

WHEREAS, a Joint Exercise of Powers Agreement between the City of Brentwood, Contra Costa County, East County Transportation Improvement Authority And The State Route Bypass Authority to construct intersection improvements at the intersection of Vasco Road and Camino Diablo.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood that the Joint Exercise of Powers Agreement is hereby approved.

BE IT FURTHER RESOLVED that the Mayor and City Clerk are authorized to execute the Joint Exercise of powers Agreement attached hereto as Exhibit “A”
