Subject/Title: Amendment of 2003-2008 Memorandum of Understanding (MOU) for Miscellaneous Office Bargaining Unit

RECOMMENDATION
Approve a Resolution amending the Miscellaneous Office Employees 2003/08 MOU to provide clarification regarding work schedules of non-sworn Police Department employees as well as addressing compensation for employees called back to work after hours.

PREVIOUS ACTION
The City Council approved Resolution 2877 ratifying the amendments to the MOU documents between the City and Miscellaneous Office and Public Works bargaining units, as well as Department Heads, Brentwood Police Lieutenants and Mid-Managers for fiscal years 2003-2008.

BACKGROUND
As provided in the adopted 2003-2008 MOU for the Miscellaneous Office bargaining unit, staff met with representatives of the bargaining unit to continue to meet and confer on the item pertaining to work schedules of non-sworn Police Department employees. The attached “Addendum to MOU Agreement Item #7A dated July 1, 2003 through June 30, 2008”, provides the method to be used in determining work schedules of non-sworn Police Department employees.

An additional issue related to work performed after the end of the workday also surfaced through the discussions. At times, members of this bargaining unit receive calls to report back to work to respond to an emergency or to provide necessary assistance to staff that is on duty. The bargaining unit has requested Call-Back pay in order to provide compensation for members of this bargaining unit in the same manner as provided to members of the Public Works bargaining unit. The proposed text provides equity between the bargaining units.

FISCAL IMPACT
There will be no fiscal impact as compensation for call back shall be provided in the form of compensatory time off or in accordance with available overtime funds budgeted in the adopted 2003/05 Budget.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD RATIFYING TWO ADDITIONAL AMENDMENTS TO THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY AND MISCELLANEOUS BARGAINING UNIT, FOR FISCAL YEARS 2003-2008.

WHEREAS, the Brentwood Miscellaneous Office Employees’ Association met with staff and conferred in good faith regarding work schedules of non-sworn Police Department employees as well as addressing compensation for employees called back to work after hours, and

WHEREAS, the amendments addressing two additional amendments to the Memorandum of Understanding for said bargaining unit are attached and identified as Addendum to MOU Agreement Item #7A and #7B, and

WHEREAS, the revised Memorandum of Understanding is entered into pursuant to the Meyers-Milias-Brown Act (California Government Code Sections 3500-3510) and has been jointly prepared by the aforementioned entities.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood hereby adopts a resolution and approves the amendments to the 2003-2008 Memorandum of Understanding with the Miscellaneous Office Employees’ Association for fiscal years beginning 2003/2004 – 2007/2008 and authorizes the terms and conditions therein to be implemented effective July 1, 2003.
