RECOMMENDATION
Approve a Resolution authorizing the City Manager or his designee to execute an Agreement for Maintenance of State Highways in the City of Brentwood.

PREVIOUS ACTION
On February 9, 1998 the City of Brentwood City Council passed Resolution No. 99-49 approving and authorizing Amendments of the Agreement for Maintenance of State Highways in the City of Brentwood.

BACKGROUND
The City of Brentwood has performed the pavement sweeping; maintenance cleaning and repairs of curbs, gutters and sidewalks; landscape maintenance and electrical repair for the section of Highway 4 from Brentwood Boulevard, from north City limits approximately 340 feet south of Delta Road to south City limits at Main Canal, a length of 3.44 miles. An agreement for partial reimbursement from the Department of Transportation had ensured the City was recovering a portion of the labor costs associated with maintaining the State Highway through Brentwood. Previous reimbursement for maintenance was $6,650 per year.

DISCUSSION
Staff approached the Department of Transportation to determine if the agreement and payment could be amended to reflect and recover actual costs associated with the City’s maintenance of this stretch of road. CalTrans representatives were unwilling to compensate the City for 100% of the services provided. They informed staff that the Brentwood sweeping and maintenance schedule was greater than what they provide for other highways. Negotiation for a reasonable compensation amount was discussed. This amount was determined to be $10,850 per year. This is a $4,200 increase over the previous allotment of $6,650 per year.

FISCAL IMPACT
There is no negative fiscal impact on the City of Brentwood.

RESOLUTION NO.


APPROVE A RESOLUTION AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO EXECUTE AN AGREEMENT FOR MAINTENANCE OF STATE HIGHWAYS IN THE CITY OF BRENTWOOD.

WHEREAS, the City of Brentwood and CalTrans have had a previous agreement for the maintenance of State Highway 4 and,

WHEREAS, the agreement has previously been amended and,

WHEREAS, a new agreement has been negotiated and,

WHEREAS, said new agreement will increase the total authorized reimbursement amount to the City of Brentwood to $10,850 per year,

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood adopts the attached Agreement for Maintenance of State Highways in the City of Brentwood and authorizes the City Manager or his designee to execute said agreement on behalf of the City.
