Subject/Title: A Contract Amendment for a Professional Services Agreement with Raney Planning & Management, Inc. for the Lone Tree Way – Union Pacific Railroad Undercrossing, CIP Project No. 336-3134, for the completion of an Environmental Impact Report.

RECOMMENDATION
Approve a Resolution to execute a contract amendment between Raney Planning and Management, Inc. (RPM) and the City of Brentwood to complete the required Environmental Impact Report for the Lone Tree Way – Union Pacific Railroad Undercrossing, CIP Project No. 336-3134.

PREVIOUS ACTION
On May 7, 2002, the Planning Commission approved the Negative Declaration and determined that the 2002/07 Capitol Improvement Program was consistent with the adopted Brentwood General Plan.

On May 28, 2002, the City Council adopted the 2002/07 Capital Improvement Program which included the Lone Tree Way – Union Pacific Railroad Undercrossing, CIP Project No. 336-3134.

On December 10, 2002, the City Council authorized staff to execute a Professional Service Agreement with Raney Planning & Management, Inc. (RGM) to prepare the Environmental Impact Report for the Lone Tree Way – Undercorssing Project, CIP Project No. 336-3134.

BACKGROUND
The Lone Tree Way – Union Pacific Undercrossing, CIP Project No. 336-3134, will construct an underpass consisting of six travel lanes under the Union Pacific Railroad. This project will improve traffic flow, accommodate the widening currently under construction to the west and anticipated to the east, as well as fulfill the City’s requirement by the Public Utilities Commission for the allowance of an at-grade crossing of the same rail line at Sand Creek Road.

Based on CEQA’s requirement, this EIR is necessary and is needed to analyze traffic, air quality, noise and biological resources. RPM will prepare an Initial Study to address the environmental effects of this project, an Administrative Draft EIR, the Mitigation Monitoring Plan and the Final EIR, which is currently anticipated to be complete by June 27, 2003.

RPM specializes in CEQA processing and documentation and, because they have worked on various projects in Brentwood and the surrounding area, they are familiar with the environmental issues of Brentwood and the immediate area adjacent to this project. Based of their qualifications and expertise, we are recommending RPM for the preparation of the required EIR for this project.


FISCAL IMPACT
There is no net fiscal impact associated with this Contract Amendment as the amendment only extends the contract from July 31, 2003 to July 31, 2004. Previous Council action approved the contract amount of $85,427.00.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT AMENDMENT WITH RANEY PLANNING & MANAGEMENT, FOR THE LONE TREE WAY – UNION PACIFIC RAILROAD UNDERCROSSING, CIP PROJECT NO. 336-3134, FOR THE COMPLETION OF AN ENVIRONMENTAL IMPACT REPORT

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood hereby authorizes the City Manager to execute a Contract Amendment between Raney Planning and Management, Inc., and the City of Brentwood to complete the required Environmental Impact Report for the Lone Tree Way – Union Pacific Railroad Undercrossing, CIP Project No. 336-3134.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 22nd day of July 2003by the following vote:

AMENDMENT ONE
TO
AGREEMENT FOR PROFESSIONAL SERVICES
OF RANEY PLANNING & MANAGEMENT, INC.


This Amendment is entered into on July 22, 2003 by and between the City of Brentwood and Raney Planning & Management, Inc.

WHEREAS, on December 10, 2002, the City of Brentwood entered into a contract to obtain specific skills and technical expertise in the preparation of the Environmental Impact Report for the Lone Tree Way – Undercrossing Project, CIP Project No. 336-3134.

NOW, THEREFORE, IT IS AGREED as follows:

1. Section 4, of the original contract, entitled term, is amended to change the stated termination date of the contract from July 31, 2003 to July 31, 2004.

2. All other terms remain unchanged.
