Subject/Title: Public Hearing for the appeal of the Planning Commission’s
decision in regard to the elimination or modification of a Condition of
Approval regarding affordability for the Design Review of a 178 unit
apartment complex. This project is generally located south of Lone Tree Way
and east of Shady Willow Lane.

Staff recommends that the City Council open the public hearing for any
comments and continue the hearing to the meeting of August 12, 2003, in
order to allow time for the Housing Subcommittee to meet and discuss options
for this project and provide a recommendation to the Council.
On March 10, the Planning Commission held a special meeting and subsequently
approved this project which included a rezone from a mix of R-2 and R-3 to
PD-63 and a Design Review for the apartment project. Subsequently the City
Council approved the rezone of this site on April 8, 2003. On June 3, 2003,
the Planning Commission heard a request for modification of the approved
Design Review to modify or eliminate Condition No. 53 which required the
applicant to maintain a 20% affordability requirement for the project. This
request was unanimously denied by the Commission.
Due to conflicting appointments by subcommittee members, staff has been
unable to bring this item to the full Housing Subcommittee for consideration
prior to providing a recommendation to the City Council. Continuance of this
item to August 12, 2003, will provide the time necessary to bring this item
to the Housing Subcommittee on July 31, 2003.
