Subject/Title: Set Public Hearing for an Appeal of Signature Homes Rezone Amendment to PD-45, TSM 8534, DR02-33 and the Mitigated Negative Declaration prepared for the project proposed north of Sycamore Avenue at it’s existing east end.

RECOMMENDATION:
Set the public hearing for this appeal for the meeting of August 12, 2003.

PREVIOUS ACTION
The City Council created PD-45 in November, 2001 in conjunction with the adoption of the new General Plan. At the time, this planned development was created as a “shell” PD, without development standards.

BACKGROUND
On July 1, 2003, the Planning Commission by passage of Resolutions 03-45 and 03-46 recommended that the City Council amend PD-45 by creating development standards for a 54.69 acre parcel located along the north side of Sycamore Avenue at its present easterly terminus, approve TSM 8534 subdividing this parcel into 177 single family residential lots and four remainder parcels which included two “pocket parks” and a woman’s shelter, and a residential design review for eight models on the 177 lots. Included within this recommendation was approval of a Mitigated Negative Declaration prepared for the project.

On July 10, 2003, within the ten day appeal period established under the Brentwood Municipal Code, Mr. Richard G. Bates, Jr. filed an appeal of the Planning Commission’s action on the above referenced project applications. As required by City Code, Mr. Bates has paid the appropriate appeal fee and has provided a written statement as to where he believes there was an error or abuse of discretion by the Planning Commission in its action on the project and where the Commission’s decision was not supported by evidence on the record.
