Subject/Title: Approve a Resolution Quitclaiming an unimproved portion of Chestnut Street to Signature Properties, Inc.

RECOMMENDATION
Approve a Resolution authorizing the Mayor or City Manager and City Clerk or any of their designees to execute a Quitclaim Deed terminating any interest the City of Brentwood may have in an unimproved portion of Chestnut Street, formerly known as Brentwood Road and shown on Brentwood Irrigation Farms #4 filed September 11, 1917 in Book 16 of Maps at Page 325, Contra Costa County, generally located between Garin Parkway and Sellers Avenue, and hereby conveying whatever interest the City may have in said unimproved portion of Chestnut Street to Signature Properties, Inc., a California Corporation.

BACKGROUND
Signature Properties Final Map for Subdivision No. 8537 was filed on April 7, 2003 by Instrument No. 2003-157602. Recently it was discovered that there is a two-foot discrepancy in the survey the plans for this subdivision were based on. This discrepancy affects only twelve lots of the seventy-eight lots in the subdivision.

Signature Properties has requested that the City Quitclaim two-feet of the unimproved Chestnut Street right-of-way to the twelve lots that are affected by this discrepancy.

Staff has determined that the area being requested by Signature does not impact the City’s needs due to some alignment changes. The City will keep the necessary right-of-way for streets. Staff has also sent a letter to all utilities to determine if they maintain facilities within the area or have future need of the proposed abandonment area. Based on the response to our inquiry, any Quitclaim from the City would require us to reserve a Public Utility Easement over and across the area for maintenance and replacement of existing utility poles and overhead wires

Staff recommends quitclaiming any possible interest the City may have in the unimproved two-foot strip along Chestnut Street, however, reserving the Public Utility Easement.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE MAYOR OR CITY MANAGER AND CITY CLERK OR ANY OF THEIR DESIGNEES TO EXECUTE A QUITCLAIM DEED TERMINATING ANY INTEREST THE CITY OF BRENTWOOD MAY HAVE IN AN UNIMPROVED PORTION OF CHESTNUT STREET, FORMERLY KNOWN AS BRENTWOOD ROAD AND SHOWN ON BRENTWOOD IRRIGATION FARMS #4 FILED SEPTEMBER 11, 1917 IN BOOK 16 OF MAPS AT PAGE 325, CONTRA COSTA COUNTY, GENERALLY LOCATED BETWEEN GARIN PARKWAY AND SELLERS AVENUE AND HEREBY CONVEYING WHATEVER INTEREST THE CITY MAY HAVE IN SAID UNIMPROVED PORTION OF CHESTNUT STREET TO SIGNATURE PROPERTIES, INC., A CALIFORNIA CORPORATION, AND ANY OTHER DOCUMENTS NECESSARY TO TEMINATE CITY INTEREST IN THE UNIMPROVED PORTION OF CHESTNUT STREET.

WHEREAS, Staff has determined that the area being requested by Signature Properties does not impact the City’s needs; and

WHEREAS, the City would reserve a Public Utility Easement over and across the area for maintenance and replacement of existing utility poles and overhead wires; and

WHEREAS, a Quitclaim Deed is required to transfer any interest the City may have to said unimproved area of Chestnut Street.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood authorizes the Mayor or City Manager and City Clerk or any of their designees to execute a Quitclaim Deed terminating any interest the City of Brentwood may have in an unimproved portion of Chestnut Street, formerly known as Brentwood Road and shown on Brentwood Irrigation Farms #4 filed September 11, 1917 in Book 16 of Maps at Page 325, Contra Costa County, generally located between Garin Parkway and Sellers Avenue, and hereby conveying whatever interest the City may have in said unimproved portion of Chestnut Street to Signature Properties, Inc., a California Corporation, and any other documents necessary to terminate City’s interest in the unimproved portion of Chestnut Street.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 24th day of June 2003 by the following vote:
