RECOMMENDATION
Approve a Resolution authorizing the City Manager to execute a Purchase Order in an amount not-to-exceed $30,000 with Cerco Analytical for the remainder of the 2002/03 fiscal year.

PREVIOUS ACTION
Council approved Resolution No. 2619 on July 23, 2002 authorizing the City Manager to execute Purchase Orders or Contracts for the not-to-exceed dollar amounts for various vendors.

BACKGROUND
As part of the start up of the new treatment facility there has been unexpected analytical testing requirements by the California Regional Water Quality Control Board that are outside the normal scope of the facilities discharge permit. These requirements have included Methylene Blue Active Substances (MBAS) analytical testing due to foam being detected in the creek, extra total coliform sampling to ensure control parameters for effluent discharge to Marsh Creek, and total and fecal coliform sampling required to ensure that the raw sewage spill that occurred was thoroughly cleaned up. Lower detection limits were also required on effluent sampling, which cost more than expected.

Council previously authorized the City Manager to execute a Purchase Order for Cerco Analytical in an amount not-to-exceed $116,000. The Wastewater Division is now requesting approval for an additional amount not-to-exceed $30,000 for Cerco Analytical.

FISCAL IMPACT
The amount of $30,000 can be funded through the Wastewater Division.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO EXECUTE A PURCHASE ORDER IN AN AMOUNT NOT-TO-EXCEED $30,000 WITH CERCO ANALYTICAL FOR THE REMAINDER OF THE 2002/03 FISCAL YEAR.

WHEREAS, Council authorized the City Manager to execute Purchase Orders or Contracts for the not-to-exceed dollar amounts for various vendors on July 23, 2002 by Resolution No. 2619; and

WHEREAS, with the start up of the new treatment facility there have been unexpected analytical testing requirements imposed by the California Regional Water Quality Control Board.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood, that the City hereby authorizes the City Manager to execute a Purchase Order with Cerco Analytical in an amount not-to-exceed $30,000.
