RECOMMENDATION
Approve a Resolution accepting the offers of dedication in fee for the rights-of-way of Country Club Drive (West and East) and Balfour Road Widening for public use as shown on the Final Map; accepting the offers of dedication for all the easements; accepting all subsurface mineral and water rights relinquished on the Final Map and accepting all improvements for maintenance, accepting the Subdivision Maintenance Bonds and releasing the Subdivision Improvement Securities for Country Club Drive, Balfour Widening, Lot #2 and Lot #14, Brookfield Homes, Subdivision No. 8323, located north of Balfour Road in the Brentwood Lakes area.

PREVIOUS ACTION
On March 9, 1993, the Planning Commission approved Resolution No. 93-27, approving Tentative Subdivision Map No. 7705 with conditions.

On May 9, 2000, the City Council approved Resolution No. 2070, approving the Final Map of Subdivision No. 8323 with improvement securities and a Subdivision Improvement Agreement.

On June 26, 2001, the City Council approved Resolution No. 2318, accepting Lot #14 for Park purposes for maintenance and accepted the Maintenance Bonds for this park.

On October 22, 2002, the City Council approved Resolution No. 2710, accepting Lot #2 for Park purposes for maintenance and accepted the Maintenance Bonds for this park.

BACKGROUND
The Final Map is located north of Balfour Road in the Brentwood Lakes area and was recorded on June 27, 2000, in Book 421 of Maps, at Page 1, Contra Costa County Records. Per Vesting Tentative Map No. 7705 for this site, Developer (Brookfield Homes) was conditioned to build 940 single residential lots on 441 acres; a 7.93 acre park, maintained by the City; 5 mini-parks and open space area that will be maintained by the homeowners. This Tentative Map covers the area north of Balfour Road, west of the Hwy 4 Bypass – Segment 2; east of the City limit line and south of the Brentwood Hills Subdivision, that is just south of San Jose Avenue.

The subdivision contains 14 parcels and a 7.93 acre park. In conjunction with the Final Map, the Developer provided improvement securities (Performance and Payment Bonds) for these improvements. Following are the major improvement quantities installed: 6,400 L.F. of sanitary sewer lines, 8,670 L.F. of waterlines, 5,900 L.F. of non-potable waterline, 5,633 L.F. of storm drain lines, 5,460 L.F. of sidewalk, 5,460 L.F. of curb and gutter, 321,460 S.F. of pavement, and 33 streetlights. A final inspection of these improvements found them to be complete and in conformance with the approved improvement plans.

The parcels were offered for dedication on the Final Map. When the Final Map was approved by the City Council, the offers of dedication were accepted subject to acceptance of improvements. Now that the parcels are improved, the City must accept the improvements in order to obtain rights to the parcels offered on the Final Map. The Developer of Subdivision No. 8323, Brookfield Homes, has already provided a Maintenance Bond (Bond No. 219001in the amount of $529,500) to cover the twelve-month warranty period for all in-tract improvements.

FISCAL IMPACT
After the acceptance of improvements, the City will then incur costs in the amount of $31,500 for all improvements associated with street sweeping and necessary repairs to streets and utilities. Regular roadway maintenance will be funded by the general fund, Measure “C”, gas tax, and sewer and water maintenance will be funded through respective enterprise funds. The Lighting and Assessment Maintenance District (LLD 97-1) has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION IN FEE FOR STREETS RIGHTS OF WAY, FOR ALL PARCELS AND EASEMENTS FOR PUBLIC USE AS SHOWN ON THE FINAL MAP, ACCEPTING THE PUBLIC IMPROVEMENTS (WATER, SANITARY SEWER, STORM DRAIN, FIBER OPTICS AND STREETS WITH ALL RELATED IMPROVEMENTS) FOR MAINTENANCE, ACCEPTING THE SUBDIVISION MAINTENANCE BONDS, AND RELEASING THE SUBDIVISION PERFORMANCE AND PAYMENT BONDS FOR COUNTRY CLUB DRIVE, BROOKFIELD HOMES, SUBDIVISION NO. 8323, LOCATED NORTH OF BALFOUR ROAD IN THE BRENTWOOD LAKES AREA

WHEREAS, on March 9, 1993, the Planning Commission approved Resolution No. 93-27, approving Tentative Subdivision Map No. 7705 with conditions; and

WHEREAS, on May 29, 2000, the City Council approved Resolution No. 2070, approving the Final Map of Subdivision No. 8323 with improvement securities and a Subdivision Improvement Agreement; and

WHEREAS, on June 26, 2001, the City Council approved Resolution No. 2318, accepting Lot #14 for Park purposes for maintenance and accepted the Maintenance Bonds for parks and open space; and

WHEREAS, on October 22, 2002, the City Council approved Resolution No. 2710, accepting Lot #2 for Park purposes for maintenance and accepted the Maintenance Bonds for parks and open space; and

WHEREAS, the required public improvements have been completed and are in conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements (waterlines, sanitary sewer, storm drain, fiber optics and streets with all related improvements) are hereby accepted for maintenance, and the offer of dedications for public use of all the streets and parcels as offered for dedication on the Final Map are hereby accepted.

BE IT FURTHER RESOLVED that the Maintenance Bonds to guarantee against defects in material and workmanship for a period of twelve months are hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.

BE IT FURTHER RESOLVED that the offers of dedication in fee are hereby accepted for rights-of-way of Country Club Drive (West and East) and widening of Balfour Road and that the offers of dedication are hereby accepted for all easements and all subsurface mineral and water rights relinquished as shown on the Final Map of Subdivision No. 8323.

BE IT FURTHER RESOLVED that the City Clerk is herby directed to file this Resolution with the Recorder of Contra Costa County.
