Subject/Title: Set the date for the appeal of Condition No. 42 for Tentative Subdivision Map No. 8627 and Design Review No. 02-06, Garin Ranch Mixed Use Project.

Set June 10, 2003 as the public hearing date to consider the appeal by Signature Properties.


On May 6, 2003 the Planning Commission held a public hearing to consider Tentative Subdivision Map No. 8627 and Design Review No. 02-06 for the Garin Ranch Mixed Use Project to subdivide 13 acres into 105 Townhouse Lots and 64 Cluster Home Lots and for the construction of 5 plans on the 64 Cluster Home lots and 3 plans on the 105 Townhouse lots. The Commission voted 4 – 1 to approve this Tentative Subdivision Map and Design Review application.

By the attached letter dated May 15, 2003, as required by the Zoning Code Section 17.880.003 D, Joseph Zawidski for Signature Properties submitted a written statement as to where he believes there was an error or abuse of discretion made by the Planning Commission in the consideration and action on the matter being appealed. Per Zoning Code Sections 17.880.002 and 003 B and E (Appeal Procedure and Set Hearing) the applicant’s appeal letter is being forwarded to the City Council. It is recommended that the City Council set June 10, 2003 as the date for the public hearing on the appeal request.
