Subject/Title: Closure of Certain Streets to Facilitate the Brentwood Chamber of Commerce’s Cornfest 2003

RECOMMENDATION

Adoption of a Resolution authorizing the closure of certain streets and temporarily establishing no parking restrictions and tow away zones in order to facilitate the Chamber of Commerce’s Cornfest 2003 to held July 11, 12, and 13, 2003.

PREVIOUS ACTION

Historically, the City has approved sponsorship and has authorized the Brentwood Chamber of Commerce to hold the Cornfest since 1992.

BACKGROUND

The Brentwood Chamber of Commerce is requesting the closure of certain streets as noted on the attached Resolution for Cornfest 2003. The Chamber of Commerce has sponsored the event for ten years.

This year the Cornfest would be open to the public Friday, July 11, 2003 between the hours of 5:00 p.m. and 11:00 p.m., Saturday, July 12, 2003 between the hours of 10:00 a.m. and 11:00 p.m., and Sunday, July 13, 2003 between the hours of 10:00 a.m. and 6:30 p.m.

Chuck Collondrez is the Chamber of Commerce’s Cornfest Chairman.

The Pyrotechnical Show is planned for Saturday, July 12, 2003 at about 9:45 p.m. The Cornfest Committee will work with the Liberty Union High School District on the logistics. The Cornfest Committee has agreed to provide security officers to assist the Police Department in securing the campus.

As in previous years, Cornfest 2003 will encompass a little over one city block with the focus around City Park. Entrances to the event are planned for Oak Street at Midway Alley, and Second Street south of Brentwood Blvd. The Chamber Cornfest Committee estimates that attendance will exceed 40,000 people over the three day period. The Chamber will use portable chain link fencing in conjunction with existing fencing and buildings to establish the event grounds. This allows the Chamber to control the overall operation of the event. The Chamber Cornfest Committee will obtain general liability insurance in addition to obtaining all the necessary permits required to hold this event.

Street closure changes for this year are the closure of the westbound lane of Oak Street between Midway Alley and First Street, and Midway Alley between Oak Street and Maple Street. This was necessary to establish a degree of safety for people waiting in line at the Oak Street gate. The Chamber has requested the use of the public parking lot on Second Street (Lake Movers lot) beginning Wednesday, July 9, 2003 at 5:00 p.m. to be used for staging equipment.

As in the past, the Chamber Cornfest Committee has requested the use of the public parking lot on Brentwood Blvd. north of Oak Street. They have also requested the use of the dirt lot at Oak Street and Walnut Blvd. and will work with the Redevelopment Agency on the permit process. The Chamber uses these lots along with other private property lots as parking lots, to raise funds for specific sports groups.

FISCAL IMPACT

The total cost of providing police services for the 2002 Cornfest was $25,516.31. The Chamber of Commerce will reimburse the City for police services. The Police Department will deploy Reserve Officers, Community Service Officers, BACUP volunteers and Explorers where appropriate to reduce personnel costs.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CLOSURE OF CERTAIN STREETS AND TEMPORARILY ESTABLISHING NO PARKING RESTRICTIONS AND TOW AWAY ZONES IN ORDER TO FACILITATE THE CHAMBER OF COMMERCE CORNFEST 2003 TO BE HELD JULY 11, 12, AND 13, 2003.

WHEREAS, the Brentwood Chamber of Commerce will hold Cornfest 2003 on Friday, July 11, between the hours of 5:00 p.m. and 11:00 p.m., on Saturday, July 12, between the hours of 10:00 a.m. and 11:00 p.m., and on Sunday, July 13, between the hours of 10:00 a.m. and 6:30 p.m., with clean-up to follow; and

WHEREAS, to accommodate the Chamber of Commerce Cornfest 2003, the Chamber has requested that the following streets and parking lots be closed to traffic, no parking and tow away zones be established:

· Maple Street, between Second Street and the end of Third Street including the Library Lot, between the hours of 5:00 p.m. Wednesday, July 9, 2003 and 10:00 p.m. Sunday, July 13, 2003.

· City Parking lot on Second Street commonly referred to as the Lake Movers lot, between 5:00 p.m. Wednesday, July 9, 2003 and 10:00 p.m. Sunday, July 13, 2003.

· Maple Street, between Midway Alley and Second Street, between the hours of 6:00 p.m. Thursday, July 10, 2003 and 10:00 p.m. Sunday, July 13, 2003.

· Second Street, between Brentwood Blvd. and 30’ south of Oak Street, between the hours of 6:00 p.m. Thursday, July 10, 2003 and 10:00 p.m. Sunday, July 13, 2003.

· Pine Street, between Midway Alley and Second Street, between the hours of 6:00 p.m. Thursday, July 10, 2003 and 10:00 p.m. Sunday, July 13, 2003.

· Oak Street, between Midway Alley and the mid-block of Third Street and Fourth Street, between the hours of 6:00 p.m. Thursday, July 10, 2003 and 10:00 p.m. Sunday, July 13, 2003.

· Oak Street, between the mid-block of Third Street and Fourth Street, to the east property line of Liberty Union High School District property, between the hours of 11:00 p.m. Friday, July 11, 2003 and 11:00 p.m. Saturday, July 12, 2003.

· Midway Alley, between Oak Street and Maple Street, between the hours of 5:00 p.m. Friday July 11, 2003 and 10:00 p.m. Sunday, July 13, 2003.

· The west bound lane of Oak Street, between Midway Alley and First Street between 5:00 p.m. Friday, July 11, 2003 and 10:00 p.m. Sunday, July 13, 2003.

WHEREAS, pursuant to Vehicle Code Section 21101(e), the City may temporarily close portions of streets for parades and local special events such as Cornfest 2003 when the closing is necessary for the safety and protection of persons who are to use those portions of the streets during the temporary closure; pursuant to Vehicle Code Section 22507, the City may prohibit parking on portions of streets during all or certain hours of the day; pursuant to Vehicle Code Section 22651(b), (m), and (n), City peace officers may remove by towing any vehicle from those portions of the streets where parking is prohibited; and

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the Police Department is ordered to close the above mentioned streets, prohibit parking and establish a tow away zone between the hours of 5:00 p.m. Wednesday, July 9, 2003 and 10:00 p.m. Sunday, July 13, 2003.
