Subject/Title: Closure of Certain Streets to Facilitate the Second Annual One Day at a Time Program Car Show Fundraiser

RECOMMENDATION Adopt a Resolution authorizing the closure of certain streets to facilitate the Second Annual One Day at a Time Car Show Fundraiser on Sunday, June 1, 2003.

PREVIOUS ACTION Last year the City Council approved the first Car Show Fundraiser for the One Day at a Time Program.

BACKGROUND The One Day at a Time Program is requesting permission to close certain streets that are adjacent to City Park for the Car Show Fundraiser. The event is expected to draw up to 300 participants and 1,000 attendees. Johnny Rodriguez, the Director of the One Day at a Time Program, is the person in charge of the event and has already received permission to use City Park for the Show. Mr. Rodriguez is receiving assistance in the planning and sponsorship of this event from Street Low Magazine. An entrance fee will be charged for participants and there will be an admission fee at the gate.

Oak Street from Second Street to Third Street, Second Street to Maple Street, and Maple Street east will be closed for the event. The intersections of these streets are included in the closure. The Library lot and City Hall parking lot will be closed.

FISCAL IMPACT The cost of Police services for last years event was $2,104.80. The One Day at a Time Program paid for police services last year. The One Day at a Time Program has requested a waiver from the City for police costs for this event. The Resolution currently does not include a waiver. If a waiver is granted for routine police costs, the City Council should amend the Resolution to include the waiver or provide direction to staff to charge no fees.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CLOSURE OF CERTAIN STREETS IN ORDER TO FACILITATE THE ONE DAY AT A TIME PROGRAM CAR SHOW FUNDRAISER ON SUNDAY, JUNE 1, 2003.

WHEREAS, the One Day at a Time Program will hold its Second Annual Car Show Fundraiser on Sunday, June 1, 2003 which will attract great numbers of people to the community; and

WHEREAS, to accommodate the One Day at a Time Car Show Fundraiser, it is requested that the following streets be closed to traffic, no parking, and tow away zones be established between the hours of 4:00 a.m. and 10:00 p.m. on the day of the event:

• Maple Street east from Second Street including the Library parking lot.
• Oak Street from Third Street, including the intersection of Oak Street and Third Street to Second Street including the intersection of Oak Street and Second Street.
• Second Street from Oak Street to Maple Street including the intersection of Second Street and Maple Street.
• City Hall parking lot.

WHEREAS, pursuant to Vehicle Code Section 21101(e), the City may temporarily close portions of streets for local events such as the One Day at a Time Program Car Show Fundaraiser when the closing is necessary for the safety and protection of persons who are to use those portions of the street during the temporary closure; pursuant to Vehicle Code Section 22507, the City may prohibit parking on portions of the streets during all or certain hours of the day; pursuant to Vehicle Code Section 22651(b), (m), and (n), City peace officers may remove by towing any vehicle from those portions of the street where parking is prohibited; and

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the Brentwood Police Department is ordered to close the above mentioned streets, prohibit parking, and establish tow away zones between the hours of 4:00 a.m. and 10:00 p.m. on Sunday, June 1, 2003 for the One Day at a Time Program Car Show Fundraiser.
