RECOMMENDATION
Reject the claim submitted by Pearl Carter Stredni as recommended by the City’s third-party insurance adjuster, Contra Costa County Municipal Risk Management Insurance Authority and the City Attorney

BACKGROUND
Pearl Carter Stredni presented a claim on October 18, 2002 in the amount of $410.00 for an incident that took place on October 2, 2002 at 11:00 a.m. at Fairview Drive and Sand Creek Road. The claimant alleges that she was driving her 2000 Volvo up Fairview towards Lone Tree Way when she encountered noise hitting her left front light area as a result of debris on the roadway. The claimant stated that there were many men working on the road area.

Granite Construction Company was engaged as the City’s contractor for installation of the new Sand Creek Road. They had been using the Sand Creek Road and Fairview Avenue intersection as access to the worksite. The City has indemnity rights against Granite Construction Company as well as additional insured status on a commercial general liability policy issued by American Casualty Company to Granite Construction Company. The loss has been tendered to Granite Construction Company and American Casualty Company for resolution.
