Subject/Title: Accept the Work Performed by Antioch Paving Company for the Pavement 2001/2002 Pavement Management Program, CIP Project No. 336-3083 (01/02).

RECOMMENDATION
Approve a Resolution accepting the work performed by Antioch Paving Company for the 2001/2002 Pavement Management Program, CIP Project No. 336-3083 (01/02), and direct the City Clerk to file a Notice of Completion with the County Recorder.

PREVIOUS ACTION
On May 22, 2001, the City Council approved and adopted the 2001/06 Capital Improvement Program for the City. The Pavement Management Program, CIP Project No. 336-3083 (01/02) is a part of this program.

BACKGROUND
The City advertised the project for construction beginning June 19, 2002.

At the bid opening on July 2, 2002, a total of six (6) bids were received. The bids were reviewed and the lowest responsive, responsible base bid was received from Antioch Paving Company, Inc.

On July 9, 2002, the City Council awarded the construction contract for the 2001/2002 Pavement Management Program, to Antioch Paving, Inc. in the amount of $307,449.64.

The list of streets included in the 2001/2002 Pavement Management Program were: Broderick Drive, Pine Street (from Brentwood Boulevard to Second Street), Maple Street (from Brentwood Boulevard to Second Street), Oak Street (from Brentwood Boulevard to Third Street), Chestnut Street (from Brentwood Boulevard to Second Street), First Street (from Pine Street to Fir Street) and Second Street (from Chestnut Street to Brentwood Boulevard).

FISCAL IMPACT
This project is part of the City’s Pavement Management Program 2001/2002, and includes design and is funded through Measure C and the General Fund. The project will increase the life of existing pavement.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE WORK PERFORMED BY ANTIOCH PAVING COMPANY, INC. FOR THE 2001/2002 PAVEMENT MANAGEMENT PROGRAM, CIP PROJECT NO. 336-3083 (01/02), AND DIRECT THE CITY CLERK TO FILE A NOTICE OF COMPLETION WITH THE COUNTY RECORDER.

WHEREAS, On May 22, 2001, the City Council approved and adopted the 2001/06 Capital Improvement Program for the City. The Pavement Management Program, CIP Project No. 336-3083 (01/02) is a part of this program; and

WHEREAS, the project started in August of 2002; and

WHEREAS, the work was completed in February of 2003 and is now ready for acceptance.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood that the work performed by Antioch Paving Company, Inc. for the 2001/2002 Pavement Management Program (01/02), CIP Project No. 336-03083, is hereby accepted.

BE IT FURTHER RESOLVED that the City Clerk is hereby directed to file a Notice of Completion with the County Recorder for this project.

NOTICE OF COMPLETION

NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did on the 9th day of July, 2002 enter into an agreement with Antioch Paving Company, Inc. for 2001/2002 Pavement Management Program (01/02), CIP Project No. 336-3083. The list of streets included in the 2001/2002 Pavement Management Program were: Broderick Drive, Pine Street (from Brentwood Boulevard to Second Street), Maple Street (from Brentwood Boulevard to Second Street), Oak Street (from Brentwood Boulevard to Third Street), Chestnut Street (from Brentwood Boulevard to Second Street), First Street (from Pine Street to Fir Street) and Second Street (from Chestnut Street to Brentwood Boulevard).

The work described in the contract documents was to furnish all material, labor, and equipment necessary to complete said project.

On the 8th day of April 2003, said contract, as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
