Subject/Title: Acceptance of Improvements for “Summerset at Brentwood Country Club,” Pulte Home Corporation, Subdivision No. 8084

RECOMMENDATION
Approve a Resolution accepting the offers of dedication for easements for ingress and egress by emergency vehicles for parcels “A”, “B” and “C” (private streets); accepting the offers of dedication for the areas designated as “Storm Drain Easements” or “S.D.E.” for public use for storm, flood and surface water drainage purpose; accepting the offers of dedication for parcel “M” and areas marked as P.S.E. (Public Service Easement) as dedicated to the City of Brentwood for public use as shown on the Final Map; accepting the subsurface water and abutters rights relinquished on said Final Map and accepting public improvements (waterlines, sanitary sewer, storm drain, fiber optics and streets with all related improvements including the landscaping on Fairview Avenue), accepting the Subdivision Maintenance Bond (Bond No. 6042589-0001 in the amount of $661,672.35) and releasing the Subdivision Performance and Payment Bonds for Subdivision No. 8084, “Summerset at Brentwood Country Club” by Pulte Home Corporation, located south of Balfour Road and west of Fairview Avenue extension.

PREVIOUS ACTION
On December 16, 1997, the Planning Commission approved Resolution No. 97-39, approving Tentative Subdivision Map No. 7940 with conditions.

On February 10, 1998, the City Council approved Resolution No. 98-31, revising certain conditions of approval for Tentative Subdivision Map No. 7940.

On August 22, 2000, the City Council approved Resolution No 2140, approving the Final Map and accepting the offers of dedication shown thereon subject to acceptance of improvements, accepting the improvement security and approving the Subdivision Improvement Agreement.

BACKGROUND
The Final Map, located south of Balfour Road and west of the Fairview Avenue extension, is part of the Summerset Active Adult Community and was recorded on September 15, 2000, in Book 424 of Maps, at Page 1, Contra Costa County Records. The subdivision contains 111 single-family residential lots. In conjunction with the Final Map, the developer provided Performance and Payment Bonds. The following are the major improvement quantities installed: On-site 3,776 L.F. of 8”sanitary sewer line, 3,661 L.F. of 8” waterline and 1,102 L.F. of 12” waterline, 3,195 L.F. of 18” storm drain line, 477 L.F of 24” storm drain line, 278 L.F. of 42” storm drain line and 262 L.F. of 54” storm drain, 4,185 L.F. of 4’ wide sidewalk, 8,743 L.F. of curb and gutter, 131,976 S.F. of pavement, 27 streetlights and 291 street trees; Off-site - Fairview Avenue 1,601 L.F. of 10” sanitary sewer line, 800 L.F. of 8” waterline and 54 L.F. of 16” waterline, 3,560 L.F. of 24” waterline and 500 L.F. of 24” DIP waterline, 1,629 L.F of 18” storm drain line, 1,145 L.F. of 36” storm drain line and 526 L.F. of 42” storm drain, 4,655 L.F. of 5’ wide sidewalk, 4,655 L.F. of curb and gutter, 4,531 L.F. of median curb and gutter, 145,542 S.F. of pavement, 23 streetlights and 170,670 S.F. of landscape. A final inspection of the street improvements found them to be completed and in conformance with the approved improvement plans.

Parcels “A”, “B”, and “C” are private streets for which an easement for ingress and egress by emergency vehicles were offered for dedication to the City of Brentwood on the Final Map. In addition, parcel “M” and other areas marked “P.S.E” (Public Service Easement), and “S.D.E.” (Storm Drain Easement) were offered for dedication to the City of Brentwood on the Final Map. When the Final Map was approved by the City Council, the offers of dedication were subject to the acceptance of improvements. Now that the above improvements have been completed, the City must accept these improvements including landscaping for Fairview Avenue and the Fairview Avenue Extension, in order to obtain title to the easements and parcels offered on the Final Map. The developer for Subdivision No. 8084, Pulte Home Corporation, also has provided a Maintenance Bond (Bond No. 6042589-0001 in the amount of $661,672.35) to cover the twelve-month warranty period for these improvements.

FISCAL IMPACT
After the acceptance of the improvements, the City will then incur costs of $33,725 per year, associated with street sweeping and necessary repairs to street and utilities. A Lighting and Landscaping Assessment District (LLD 94-1) has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION FOR ALL PARCELS AND EASEMENTS SHOWN ON THE FINAL MAP, ACCEPTING THE PUBLIC IMPROVEMENTS WITH LANDSCAPING FOR FAIRVIEW AVENUE AND THE FAIRVIEW AVENUE EXTENSION FOR MAINTENANCE ACCEPTING THE SUBDIVISION MAINTENANCE BOND, AND RELEASING THE SUBDIVISION PERFORMANCE AND PAYMENT BONDS FOR SUBDIVISION NO. 8084, “SUMMERSET AT BRENTWOOD COUNTRY CLUB,” BY PULTE HOME CORPORATION, LOCATED SOUTH OF BALFOUR ROAD AND WEST OF THE FAIRVIEW AVENUE EXTENSION


WHEREAS, on December 16, 1997, by Planning Commission Resolution No. 97-39, the Planning Commission approved Tentative Subdivision Map No. 7940, with conditions; and

WHEREAS, on February 10, 1998, the City Council approved Resolution No. 99-31, revising certain conditions of approval for Tentative Subdivision Map No. 7940; and

WHEREAS, on August 22, 2000, the City Council approved Resolution No 2140, approving the Final Map of Subdivision No. 8084, Pulte Home Corporation, accepting the offers of dedication shown thereon subject to acceptance of improvements, accepting the improvement security and approving the Subdivision Improvement Agreement; and

WHEREAS, the required public improvements have been completed and are in conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements including landscaping on Fairview Avenue and the Fairview Avenue Extension are hereby accepted for maintenance, and the offer of dedications for public use of all the streets and parcels as offered for dedication on the Final Map are hereby accepted.

BE IT FURTHER RESOLVED that the Maintenance Bond (Bond No. 6042589-0001 in the amount of $661,671.35) to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bond will be released within sixty (60) days of the passage of this resolution.

BE IT FURTHER RESOLVED that the offers of dedication are hereby accepted for parcels “A” (Bismarck Terrace), “B” (Bountiful Way, Regent Drive and Malling Way), and “C” (Regent Drive) for ingress and egress by emergency vehicles, all areas marked as “P.S.E.” (Public Service Easement) for public use of the private streets, parcel “M” marked as “P.S.E.” only and “S.D.E” (Storm Drain Easement) and landscaping on Fairview Avenue and the Fairview Avenue Extension as shown on the Final Map of Subdivision No. 8084.
