RECOMMENDATION
Approve a Resolution accepting the offers of dedication in fee for the rights-of-way of Lundin Lane, Waterville Drive, Canmore Court, Haddington Court, Lenzie Court, Eaton Court, Dunwood Court, Sandyhills Lane, Tain Court and Ashford Place for public use as shown on the Final Map; accepting the offers of dedication for all the easements; accepting all subsurface mineral and water rights relinquished on the Final Map and accepting all on-site and off-site public improvements (waterlines, sanitary sewer, storm drain, fiber optics and streets with all related improvements) for maintenance, accepting the Subdivision Maintenance Bonds and releasing the Subdivision Improvement Securities for Brentwood Lakes Unit #6, Brookfield Homes, Subdivision No. 8233, located north of Balfour Road and west of West Country Club Drive.

PREVIOUS ACTION
On March 9, 1993, the Planning Commission approved Resolution No. 93-27, approving Tentative Subdivision Map No. 7705 with conditions.

On July 25, 2000, the City Council approved Resolution No. 2117, approving the Final Map of Subdivision No. 8322 with improvement securities and a Subdivision Improvement Agreement.

On October 22, 2002, the City Council approved Resolution No. 2711, accepting Parcels “A” and “B” (parks) and Parcel “C” (open space) for maintenance and accepted the Maintenance Bonds for parks and open space.

BACKGROUND
The Final Map is located north of Balfour Road and west of West Country Club Drive, and was recorded on August 9, 2000, in Book 422 of Maps, at page 34, Contra Costa County Records. The subdivision contains 174 single-family residential lots and an 8.7 acre park and open space area (2.05 acres under parks and 6.65 acres under open space). In conjunction with the Final Map, the developer provided improvement securities (Performance and Payment Bonds) for these improvements. A final inspection of these improvements found them to be complete and in conformance with the approved improvement plans.

The parcels were offered for dedication on the Final Map. When the Final Map was approved by the City Council, the offers of dedication were accepted subject to acceptance of improvements. Now that the parcels are improved, the City must accept the improvements in order to obtain rights to the parcels offered on the Final Map. The developer of Subdivision No. 8322, Brookfield Homes, has already provided a Park Maintenance Bond (Bond No. 257718 in the amount of $38,091.20) and Maintenance Bonds (Bond No. 218999 in the amount of $439,500 and Bond No. 219000 in the amount of $100,350) to cover the twelve-month warranty period for the on-site and off-site improvements.

FISCAL IMPACT
After the acceptance of improvements, the City will then incur costs in the amount of $40,000 for on-site improvements and $6,000 for off-site improvements associated with street sweeping and necessary repairs to streets and utilities. Regular roadway maintenance will be funded by the general fund, Measure “C”, gas tax, and sewer and water maintenance will be funded through respective enterprise funds. The Lighting and Assessment Maintenance District (LLD 98-1) has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION IN FEE FOR STREETS RIGHT OF WAY, FOR ALL PARCELS AND EASEMENTS FOR PUBLIC USE AS SHOWN ON THE FINAL MAP, ACCEPTING THE PUBLIC IMPROVEMENTS (WATER, SANITARY SEWER, STORM DRAIN, FIBER OPTICS AND STREETS WITH ALL RELATED IMPROVEMENTS) FOR MAINTENANCE, ACCEPTING THE SUBDIVISION MAINTENANCE BONDS, AND RELEASING THE SUBDIVISION PERFORMANCE AND PAYMENT BONDS FOR BRENTWOOD LAKES UNIT #6, BROOKFIELD HOMES, SUBDIVISION NO. 8322, LOCATED NORTH OF BALFOUR ROAD AND WEST OF WEST COUNTRY CLUB DRIVE


WHEREAS, on March 9, 1993, the Planning Commission approved Resolution No. 93-27, approving Tentative Subdivision Map No. 7705 with conditions; and

WHEREAS, on July 25, 2000, the City Council approved Resolution No. 2117, approving the Final Map of Subdivision No. 8322 with improvement securities and a Subdivision Improvement Agreement; and

WHEREAS, on October 22, 2002, the City Council approved Resolution No. 2711, accepting Parcels “A” and “B” (parks) and Parcel “C” (open space) for maintenance and accepted the Maintenance Bonds for parks and open space; and

WHEREAS, the required public improvements, have been completed and are in conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements (waterlines, sanitary sewer, storm drain, fiber optics and streets with all related improvements) are hereby accepted for maintenance, and the offer of dedications for public use of all the streets and parcels as offered for dedication on the Final Map are hereby accepted.

BE IT FURTHER RESOLVED that the Maintenance Bonds to guarantee against defects in material and workmanship for a period of twelve months are hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.

BE IT FURTHER RESOLVED that the offers of dedication in fee are hereby accepted for rights-of-way of Lundin Lane, Waterville Drive, Canmore Court, Haddington Court, Lenzie Court, Eaton Court, Dunwood Court, Sandyhills Lane, Tain Court and Ashford Place and that the offers of dedication are hereby accepted for all easements and all subsurface mineral and water rights relinquished as shown on the Final Map of Subdivision No. 8322.

BE IT FURTHER RESOLVED that the City Clerk is herby directed to file this Resolution with the Recorder of Contra Costa County.
