RECOMMENDATION
Approve a Resolution accepting the offers of dedication in fee for the rights-of-way of Loring Way, Majestic Lane, Regal Drive, Halford Lane, Dawn Drive, Minnesota Avenue Widening and Fairview Avenue Widening; accepting all “Public Utility Easements” or “P.U.E.” as shown and dedicated on this Final Map; accepting all subsurface mineral and water rights relinquished on said Final Map and accepting public improvements (waterlines, sanitary sewer, storm drain, fiber optics and streets with all related improvements, all improvements constructed in EBMUD right-of-way and all off-site improvements on Fairview Avenue including the sound wall) for maintenance; accepting the Subdivision Maintenance Bonds, and releasing the Subdivision Improvement Securities for Subdivision No. 8176, by Hofmann, located in SPA “L”, just south of Grant, and east of Fairview Avenue.

PREVIOUS ACTION
On November 17, 1998, the Planning Commission approved Planning Commission Resolution No. 98-58, approving Tentative Subdivision Map No. 8055, with conditions.

On July 27, 1999, the City Council approved Resolution No. 99-180, approving the Final Map of Subdivision No. 8176 with improvement securities and a Subdivision Improvement Agreement.

BACKGROUND
The Final Map is located at the southeast corner of Fairview Avenue and Grant Street, and was recorded on August 12, 1999, in Book 413 of Maps, at page 22, Contra Costa County Records. The subdivision contains 50 single-family residential lots. In conjunction with the Final Map, the Developer provided improvement securities (Performance and Payment Bonds) for these improvements. Following are the major improvement quantities installed: 3,480 L.F. of sanitary sewer lines, 2,455 L.F. of waterlines, 1,072 L.F. of storm drain lines, 5,900 L.F. of sidewalk, 7,580 L.F. of curb and gutter, 100,769 S.F. of pavement, and 18 streetlights. A final inspection of these improvements found them to be complete and in conformance with the approved improvement plans.

The major improvements for the subdivision were Fairview Avenue widening and the trail on EBMUD right-of-way in the project frontage. Also, this subdivision shared its improvements for the SPA “L” park.

The parcels were offered for dedication on the Final Map. When the Final Map was approved by the City Council, the offers of dedication were accepted subject to acceptance of improvements. Now that the parcels are improved, the City must accept the improvements in order to obtain rights to the parcels offered on the Final Map. The Developer of Subdivision No. 8176, Hofmann, has already provided a Maintenance Bonds for In-tract Improvements and Off-site (EMBUD, Fairview Avenue and sound wall) Improvements (Bond No.11133389996M for $171,150.00 for In-tract improvements and Bond No.11119493069M for $26,850.00 for Off-site Improvements) to cover the twelve-month warranty period for these improvements.

FISCAL IMPACT
After the acceptance of improvements, the City will then incur costs of $8,700 per year, associated with street sweeping and necessary repairs to streets and utilities. Roadway maintenance will be funded by a combination of the City’s general fund, Measure “C” and gas tax funds while utilities maintenance will be funded through respective enterprise funds. A Lighting and Assessment Maintenance District (LLD 99-3) has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION IN FEE FOR STREETS RIGHT OF WAY, FOR ALL PARCELS AND EASEMENTS FOR PUBLIC USE AS SHOWN ON THE FINAL MAP, ACCEPTING THE IN-TRACT AND OFF-SITE PUBLIC IMPROVEMENTS (WATER, SANITARY SEWER, STORM DRAIN, FIBER OPTICS AND STREETS WITH ALL RELATED IMPROVEMENTS AND) FOR MAINTENANCE, ACCEPTING THE SUBDIVISION MAINTENANCE BONDS, AND RELEASING THE SUBDIVISION PERFORMANCE AND PAYMENT BONDS FOR SUBDIVISION NO. 8176, HOFMANN, LOCATED AT THE SOUTHEAST CORNER OF FAIRVIEW AVENUE AND GRANT STREET 


WHEREAS, on November 17,1998, by Planning Commission Resolution No. 99-58, the Planning Commission approved Tentative Subdivision Map No. 8055, with conditions; and

WHEREAS, on July 27, 1999, the City Council approved Resolution No. 99-180 approving the Final Map of Subdivision No. 8176, accepting the improvement security and approving the Subdivision Improvement Agreement; and

WHEREAS, the required public improvements have been completed and are in conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the in-tract and off-site public improvements (waterlines, sanitary sewer, storm drain, fiber optics and streets with all related improvements) are hereby accepted for maintenance, and the offer of dedications for public use of all the streets and parcels as offered for dedication on the Final Map are hereby accepted.

BE IT FURTHER RESOLVED that the Maintenance Bonds to guarantee against defects in material and workmanship for a period of twelve months are hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this resolution.

BE IT FURTHER RESOLVED that the offers of dedication in fee are hereby accepted for rights-of-way of Loring Way, Majestic Lane, Regal Drive, Halford Lane, Dawn Drive, Minnesota Avenue Widening and Fairview Avenue Widening; and that the offers of dedication for all “Public Utility Easements” or “P.U.E.” as shown on this Final Map are hereby accepted, and that the offers of dedication are hereby accepted for all subsurface mineral and water rights relinquished as shown on the Final Map of Subdivision No. 8176.

BE IT FURTHER RESOLVED that the City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
