RECOMMENDATION
Approve a Resolution authorizing the City Manager to execute a change order in the amount of $52,635.00 with CCS Planning and Engineering Incorporated for the Design Contract for the Brentwood Boulevard Curve, CIP Project No. 336-3100, and authorize the City Manager to approve change orders up to 10% of the contract amount. 

PREVIOUS ACTION
On October 12, 1999, the City Council approved the Design Contract with CCS Planning and Engineering Incorporated for the Brentwood Boulevard Curve, CIP Project No. 336-3100.

On February 8, 2000, the City Council authorized the application of Federal Surface Transportation Program funding for the Brentwood Boulevard Curve, CIP Project No. 336-3100, and funding was awarded July 28, 2000.

On October 20, 2000, the City Council approved Amendment No. 1 to the Professional Services Agreement with CCS Planning and Engineering Incorporated for an extension of time for the Brentwood Boulevard Curve, CIP Project No. 336-3100. 

On March 13, 2001, the City Council approved a Consultant Services Agreement with Cordoba Consulting, Inc. to provide necessary project management services for this project.

On June 26, 2001, the City Council approved Amendment No. 2 to the Professional Services Agreement with CCS Planning and Engineering Incorporated for an extension of time for the Brentwood Boulevard Curve, CIP Project No. 336-3100.

On November 13, 2001, the City Council approved Resolution No. 2404, authorizing the City Manager to execute Design Change Order in the amount of $23,430.00 with CCS Planning and Engineering Incorporated for the Brentwood Boulevard Curve, CIP Project No. 336-3100.

On May 7, 2002, by Resolution No. 02-18, the Planning Commission confirmed that the proposed 2002/03 – 2006/07 Capital Improvement Program (CIP) is consistent with the adopted General Plan of the City of Brentwood as required by Section 6540l of the Government Code.

On May 28, 2002, the City Council adopted the City’s 2002/03 – 2006/07 Capital Improvement Program that included the Brentwood Boulevard Curve, CIP Project No. 336-3100. 

On June 25, 2002, the City Council approved Amendment No. 3 to the Professional Services Agreement with CCS Planning and Engineering Incorporated for an extension of time for the Brentwood Boulevard Curve, CIP Project No. 336-3100.

On August 27, 2002, the City Council approved Resolution No. 2648, authorizing the City Manager to execute Program Supplement Agreement No. 005-M administering agency-state agreement for the Brentwood Boulevard Curve, CIP Project No. 336-3100.

On October 8, 2002, the City Council approved Resolution No. 2687, approving an agreement for purchase of a portion of real property located at Brentwood Boulevard and Second Street from the Liberty Union High School District for the Brentwood Boulevard Curve, CIP Project No. 336-3100.

BACKGROUND
The proposed project is the realignment of the 10 mph speed curve portion along Brentwood Boulevard (State Route 4) between Second Street and Pine Street. The proposed improvements will modify the super-elevation, smoothen the curve, widen the travel lanes, install a raised median, and landscape the median and parkway on the east side.

The current contract amount for the design and preparation of construction plans and specifications totals $182,748.00. This project is federally funded. This funding has some constraints and unforeseen obstacles to overcome during the plan check process for a Caltrans encroachment permit. Staff has attached the proposed scope of services and fees in the amount of $52,635.00 for the work anticipated to take the project through approval and issuance of a Caltrans encroachment permit. This additional scope of service includes to review and address Caltrans comments to finalize PS&E, and provide construction engineering support during construction.

The attached scope of services also includes a proposal for construction staking in the amount of $17,840.00. This item was excluded from earlier proposals in order to wait for the award of grant funding. The cost for the construction staking and the increased design fees, if approved, could be applied toward the 11.47% of matching funds required by the grants awarded for this project.

FISCAL IMPACT
The funds for this project are from roadway facility fees and two separate grants as shown in the existing budget as approved in this year’s Capital Improvement Program 2002/07. The grant funds awarded for this project total $920,000.00. Approval of this change order is not anticipated to cause the project to exceed the total budget currently approved.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO EXECUTE A CHANGE ORDER IN THE AMOUNT OF $52,635.00 WITH CCS PLANNING AND ENGINEERING INCORPORATED FOR THE DESIGN CONTRACT FOR THE BRENTWOOD BOULEVARD CURVE, CIP PROJECT NO. 336-3100, AND AUTHORIZE THE CITY MANAGER TO APPROVE CHANGE ORDERS UP TO 10% OF THE CONTRACT AMOUNT.

WHEREAS, on June 25, 2002, the City Council approved Amendment No. 3 to the Professional Services Agreement with CCS Planning and Engineering Incorporated for an extension of time for the Brentwood Boulevard Curve, CIP Project No. 336-3100; and

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brentwood hereby authorizes the City Manager to execute a Change Order in the amount of $52,635.00 with CCS Planning and Engineering Incorporated for the Design Contract for the Brentwood Boulevard Curve, CIP Project No. 336-3100.

BE IT FURTHER RESOLVED that the City Manager is authorized to approve change orders up to 10% of the contract amount.
