Approve a resolution authorizing the Redevelopment Agency to fund the construction contract for the Brentwood Boulevard Sanitary Sewer Improvement Project – Phase II, CIP Project No. 592-5910, in the amount of $162,000.
On April 9, 2002, the Redevelopment Agency awarded the contract for the first phase of the Brentwood Boulevard/Lone Tree Way Wastewater Improvement Project, CIP Project No. 592-5910. On June 11, 2002, the Agency accepted the construction of the first phase.
On May 28, 2002, the City Council approved and adopted the 2002/07 Capital Improvement Program for the City, of which the Brentwood Boulevard/Lone Tree Way Wastewater Project – Phase II, CIP Project No. 592-5910, is a part.
On June 25, 2002, the Redevelopment Agency approved and adopted its 2002/03 Operations Budget, of which the Brentwood Boulevard/Lone Tree Way Wastewater Project – Phase II, CIP Project No. 592-5910, is a part.
The installation and improvement of sewer and water services, to address failing and old septic tanks and well systems, has been and continues to be an objective in the Agency’s Redevelopment Plan and Implementation Plan.
Phase II of this capital improvement project, consisting of the construction of the sanitary sewer pipelines on Brentwood Boulevard across from Homecoming Way, will provide service to approximately eleven households and one business currently on septic tanks.
The construction of the domestic water pipeline on Almond Street will provide service to residents currently on wells. Since the wells are relatively shallow, risk of contamination is likely. It is economical to have the selected contractor install the water line on Almond Street at the same time as the sewer line on Brentwood Boulevard due to the close proximity of the projects, to reduce the interruption of services, and to lessen the inconvenience caused by the construction to the neighboring residents and businesses.
Earlier this evening, the City Council considered the construction contract award for this project. While the contract documents shall be between the City and the selected contractor, the construction and installation of the sewer and water improvements will be funded by the Redevelopment Agency’s Tax Allocation Bond proceeds.
The cost to construct and install the Brentwood Boulevard Sewer Improvement Project – Phase II, CIP Project No. 592-5910, in the amount of approximately $162,000 ($134,939.00 plus 20% contingency) will be funded by the Redevelopment Agency’s 2001 Tax Allocation Bond Proceeds. This project is part of the Agency’s 2002/03 Operations Budget, approved on June 25, 2002, and therefore no amendment to the Budget is necessary.

A RESOLUTION OF THE REDEVELOPMENT AGENCY
OF THE CITY OF BRENTWOOD AUTHORIZING THE FUNDING
OF THE CONSTRUCTION CONTRACT FOR THE
BRENTWOOD BOULEVARD SANITARY SEWER IMPROVEMENT PROJECT –
PHASE II, CIP PROJECT NO. 592-5910, IN THE AMOUNT OF $162,000
WHEREAS, the Redevelopment Agency of the City of Brentwood (“Agency”) adopted its 2002-2003 Budget on June 25, 2002, by Resolution No. RA-55, of which the Brentwood Boulevard Sanitary Sewer Improvements – Phase II, CIP Project No. 592-5910 (“Wastewater Improvements”), is a part; and
WHEREAS, on May 28, 2002, the City Council of the City of Brentwood (“City”) approved and adopted the 2002/07 Capital Improvement Program for the City, of which the Brentwood Boulevard Sanitary Sewer Improvements – Phase II, CIP Project No. 592-5910, is a part; and
WHEREAS, the City received eleven (11) bids on January 7, 2003, and Delta Excavating, Inc., was determined to have provided the lowest, responsible base bid, which was the basis for the City awarding the Wastewater Improvements contract to Delta Excavating Inc., in the amount of $134,939.00 with change orders up to 20% of the contract amount; and
WHEREAS, the Agency desires to fund the construction and installation costs of the Wastewater Improvements in the amount of the bid and the 20% contingency; and
WHEREAS; the Agency desires to memorialize its expenditure approvals for redevelopment programs and activities that will facilitate public improvements and facilities programs.
NOW, THEREFORE BE IT RESOLVED by the Redevelopment Agency of the City of Brentwood as follows:
1. The Agency hereby finds and determines:
a. The Wastewater Improvements will be of benefit to the Redevelopment Project Area. This finding is based on the fact that the Wastewater Improvements will be located within the Project Area and will provide improved public improvements and facilities to residents and businesses.
b. There is no other reasonable means of financing the Wastewater Improvements. This finding is based on the lack of sufficient funds in the capital improvement budget of the City to fund the Wastewater Improvements together with other urgently needed public improvements and facilities and the infeasibility of financing the Wastewater Improvements through an assessment district, community facilities district or other conventional method of financing public facilities.
c. The payment of funds for the Wastewater Improvements will assist in the elimination of one or more blighting conditions inside the Project Area, will improve public facilities and services inside the Project Area, and is consistent with the Implementation Plan. This finding is based on the following facts:
1. The Implementation Plan identifies as objectives for the five-year period from Fiscal Year 1999/00 through 2003/04 the following:
Provide needed public improvements: revitalize the redevelopment project areas through installation of public improvements, including streets, curbs, gutters, sidewalks, utility undergrounding, landscaping, sewer, water and storm drain systems, and bring area infrastructure into compliance with all Federal and State laws.
BE IT FURTHER RESOLVED that the Redevelopment Agency of the City of Brentwood hereby authorizes the funding of the Wastewater Improvements in the amount of $162,000 from its 2001 Tax Allocation Bond Proceeds.
