RECOMMENDATION 
Passage of a resolution authorizing the submittal of a grant proposal to the Metropolitan Transportation Commission 2003/2004 Transportation Development Act (TDA) Article 3 program for a bicycle project and authorizing the Parks and Recreation Director to execute and submit all documents which may be necessary.

BACKGROUND
The Transportation Development Act (TDA), Public Utilities Code § 99233.3 and 99234, makes funds available in the nine-county Metropolitan Transportation Commission (MTC) region for pedestrian/bicycle purposes. MTC makes annual allocations of TDA funds to eligible claimants after review of applications submitted. All cities and counties in each of the nine MTC region counties are eligible to claim funds under TDA Article 3 if they meet criteria in § 99234 of the Public Utilities Code and if the project is included in an adopted comprehensive bikeway plan as outlined in § 2377 of the California Bikeways Act, Streets and Highways Code.

Eligible projects for these funds include construction and/or engineering of a capital project; to maintain a bikeway which is closed to motorized traffic; for a bicycle safety education program; or to develop bicycle or pedestrian facilities plans. The City of Brentwood Bicycle Subcommittee as well as staff from the Parks and Recreation Department and the Police Department recommend that an application be submitted for curb cuts in various locations throughout the City for safe bicycle transition from Class I (off-street) bike paths to Class II (on-street) bike lanes. The locations are:

1. Balfour Road at the Marsh Creek Bridge, both north and south sides of the roadway.
2. Sand Creek Road west of Fairview Avenue, south side. Curb cuts to allow bicyclists to access sidewalk when bike lane ends.
3. Access from Trail Court from Trailside Drive off Sunset Road to the Marsh Creek Trail.
4. Stonewood Drive and the Sand Creek Trail north of Bristow School (east of Fairview Avenue).
5. Mid-point of Outrigger Circle to connect with the Sand Creek Trail (east of Fairview Avenue).
6. North end of Mulberry Place and the Sand Creek Trail (east of Fairview Avenue).
7. North end of Aspen Court and the Sand Creek Trail (east of Fairview Avenue).
8. Cul-de-sac at south end of Monterrosa Court to connect to the Deer Creek Trail (west of Fairview Avenue).
9. Cul-de-sacs at Cosmos Court and Chamois Court, eastern end of Country Glen Lane, and cul-de-sacs at Yardley Place, Wassen Court and Muscat Court to connect with the Class I trail running along the Union Pacific Railroad south of Minnesota Avenue and north of San Jose Avenue.


The curb cuts will be constructed according to the design criteria in Chapter 1000 of the Caltrans Highway Design Manual, “Bikeway Planning and Design”. This will ensure that bicyclists have a surface flush to the street so that they are not subject to potential hazards associated with crossing a vertical lip at a flat angle. All the curb cuts will be wide enough to accommodate adult tricycles and two-wheel trailers.

FISCAL IMPACT
The estimated cost for the bicycle curb cut project is $40,000 plus a 10% contingency. The proposal will request $40,000 from the TDA program and if needed, the City will contribute $4,000 for contingencies. There is no specified match requirement for this program but in order to leverage available funds a local match is desirable. Funds from the Park Planning Account are available for any needed match.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE SUBMITTAL OF AN APPLICATION FOR GRANT FUNDS TO THE METROPOLITAN TRANSPORTATION COMMISSION 2003/2004 TRANSPORTATION DEVELOPMENT ACT (TDA) ARTICLE 3 PROGRAM FOR PEDESTRIAN AND BICYCLE PROJECTS.

WHEREAS, The Transportation Development Act (TDA), Public Utilities Code Sections 99233.3 and 99234, makes funds available in the nine-county Metropolitan Transportation Commission (MTC) Region for pedestrian/bicycle purposes; and

WHEREAS, all cities and counties in each of the nine MTC region counties are eligible to claim funds under TDA Article 3; and

WHEREAS, MTC makes annual allocations of TDA funds to eligible claimants after review of applications submitted; and 

WHEREAS, as part of the priority setting for projects the City of Brentwood Bicycle Subcommittee, in conjunction with the Parks and Recreation Department and the Police Department, has selected installation of curb cuts in various locations throughout the City as their preferred project for application to this program; and 

WHEREAS, the project application was forwarded to the County Public Works Department for prioritization and comment by the Countywide Bicycle Advisory Committee and is now ready to submit to the Metropolitan Transportation Commission for consideration for funding.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood hereby approves the filing of an application with MTC for funding of curb cuts in various locations throughout the City
