Subject/Title: Approve a contract for a Professional Services Agreement with Raney Planning & Management, Inc. for the Lone Tree Way – Union Pacific Railroad Undercrossing, CIP Project No. 336-3134, for an Environmental Impact Report.

RECOMMENDATION
Approve a Resolution authorizing the City Manager to execute an agreement between Raney Planning and Management, Inc. (RPM) and the City of Brentwood in the amount of $82,427 to prepare the required Environmental Impact Report for the Lone Tree Way – Union Pacific Railroad Undercrossing, CIP Project No. 336-3134, and authorize the City Manager to execute change orders up to 10% of the contract amount.

PREVIOUS ACTION
On May 7, 2002, the Planning Commission approved the Negative Declaration and determined that the 2002/07 Capitol Improvement Program was consistent with the adopted Brentwood General Plan.

On May 28, 2002, the City Council adopted the 2002/07 Capital Improvement Program which included the Lone Tree Way – Union Pacific Railroad Undercrossing, CIP Project No. 336-3134. 

BACKGROUND
The Lone Tree Way – Union Pacific Undercrossing, CIP Project No. 336-3134, will construct an underpass consisting of six travel lanes under the Union Pacific Railroad. This project will improve traffic flow, accommodate the widening currently under construction to the west and anticipated to the east, as well as fulfill the City’s requirement by the Public Utilities Commission for the allowance of an at-grade crossing of the same rail line at Sand Creek Road. 

Based on CEQA’s requirement, this EIR is necessary and is needed to analyze traffic, air quality, noise and biological resources. RPM will prepare an Initial Study to address the environmental effects of this project, an Administrative Draft EIR, the Mitigation Monitoring Plan and the Final EIR, which is currently anticipated to be complete by June 27, 2003.

RPM specializes in CEQA processing and documentation and, because they have worked on various projects in Brentwood and the surrounding area, they are familiar with the environmental issues of Brentwood and the immediate area adjacent to this project. Based of their qualifications and expertise, we are recommending RPM for the preparation of the required EIR for this project.


FISCAL IMPACT
The proposed amount as shown on the attached proposal is $82,427, which has been accounted for in the 2002/07 CIP Budget under Planning and Design for this fiscal year. This project is funded by a combination of an Assessment District, contributions from developers and facility fees.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING A CONTRACT FOR PROFESSIONAL SERVICES WITH RANEY PLANNING & MANAGEMENT, INC., IN THE AMOUNT OF $82,427 FOR THE LONE TREE WAY – UNION PACIFIC RAILROAD UNDERCROSSING, CIP PROJECT NO. 336-3134, FOR AN ENVIRONMENTAL IMPACT REPORT, AND AUTHORIZE THE CITY MANAGER TO EXECUTE CHANGE ORDERS UP TO 10% OF THE CONTRACT AMOUNT.

BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute change orders up to 10% of the contract amount.
