RECOMMENDATION
Approve a Resolution authorizing the City Manager to execute an Actual Cost Contract with Chevron Pipe Line Company for the installation of pipeline casing across Sand Creek Road along the Union Pacific Railroad right-of-way for Sand Creek Road East, CIP Project No. 336-3061, in an amount not to exceed $135,000; and authorizing the City Manager to approve change orders up to 10% of the contract amount.

PREVIOUS ACTION
On July 23, 2002, the City Council authorized the City Manager to award a Construction Contract to Top Grade Construction Company to construct the east portion of Sand Creek Road, CIP Project No. 336-3061, from east of Minnesota Avenue, across the Union Pacific Railroad tracks, to just west of Brentwood Boulevard.

BACKGROUND
Chevron Pipe Line Company has a pipeline easement within the Union Pacific Railroad right-of-way for their petroleum line. The new Sand Creek Road will cross both the Union Pacific Railroad and the Chevron pipeline. In building the new Sand Creek Road, the City has applied for and is waiting to receive an at-grade crossing design from the Union Pacific Railroad. Building the at-grade crossing will raise the surrounding ground by as much as ten feet, which will in turn change the depth to the Chevron pipeline from the existing four feet to fourteen feet below grade. Because the new Sand Creek Road will be a major arterial through Brentwood, and because construction of the road is going to make the existing pipeline fourteen feet deep, Chevron is required and agreed to install a 300-foot long “spare” casing at approximately the same depth and parallel with the existing 8-inch diameter pipeline. The attached actual cost contract is to pay for Chevron to install the “spare” casing along their pipeline right-of-way across the new Sand Creek Road. 

FISCAL IMPACT
The funds for this work are through facilities fees, which are included in the existing budget as approved in this year’s Capital Improvement Program 2002/03.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO EXECUTE AN ACTUAL COST CONTRACT WITH CHEVRON PIPE LINE COMPANY FOR THE INSTALLATION OF PIPELINE CASING ACROSS SAND CREEK ROAD ALONG THE UNION PACIFIC RAILROAD RIGHT-OF-WAY FOR SAND CREEK ROAD (EAST), CIP PROJECT NO. 336-3061; AND AUTHORIZING THE CITY MANAGER TO APPROVE CHANGE ORDERS UP TO 10% OF THE CONTRACT AMOUNT.

WHEREAS, Chevron is required and agreed to install a 300-foot long “spare” casing at approximately the same depth and parallel with the existing 8-inch diameter pipeline.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood hereby authorizes the City Manager to execute an actual cost contract with Chevron Pipe Line Company for the installation of pipeline casing across Sand Creek Road along the Union Pacific Railroad right-of-way for the Sand Creek Road East Project, CIP Project No. 336-3061.

BE IT FURTHER RESOLVED that the City Council of the City of Brentwood hereby authorizes the City Manager to approve change orders up to 10% of the contract amount.
