Approve a Resolution accepting the offers of dedication in fee for the rights-of-way of Tradition Way, Guise Way, Heritage Way, Panorama Way, Independence Street, Morningside Street, Gerry Street, Legacy Street and Balfour Road Widening; accepting the offer of dedication in fee for Parcel “B” and “C” as shown on the Final Map; accepting all subsurface mineral, water and abutters rights relinquished on said Final Map and accepting public improvements (waterlines, sanitary sewer, storm drain, fiber optics and streets with all related improvements) for maintenance; accepting the Subdivision Maintenance Bond and releasing the Subdivision Improvement Securities for Subdivision No. 7844, Providence, by Ryder Homes and Shea Homes, located south of Balfour Road and west of Sellers Avenue.
On February 20, 1996, the Planning Commission approved Planning Commission Resolution No. 96-04, approving Tentative Subdivision Map No. 7844 with conditions.
On February 9, 1999, the City Council approved Resolution No. 99-52, approving the Final Map of Subdivision No. 7844 with improvement securities and a Subdivision Improvement Agreement.
The Final Map is located at the southwest corner of Balfour Road and Sellers Avenue, and was recorded on February 19, 1999, in Book 407 of Maps, at page 39, Contra Costa County Records. The subdivision contains 121 single-family residential lots. In conjunction with the Final Map, the developer provided improvement securities (Performance and Payment Bonds) for these improvements. Following are the major improvement quantities installed: 5,190 L.F. of sanitary sewer lines, 6,105 L.F. of waterlines, 7,445 L.F. of storm drain lines, 13,225 L.F. of sidewalk, 13,225 L.F. of curb and gutter, 261,200 S.F. of pavement and 43 streetlights. A final inspection of these improvements found them to be complete and in conformance with the approved improvement plans.
The parcels were offered for dedication on the Final Map. When the Final Map was approved by the City Council, the offers of dedication were accepted subject to acceptance of improvements. Now that the parcels are improved, the City must accept the improvements in order to obtain rights to the parcels offered on the Final Map. The developer of Subdivision No. 7844, Providence, Shea Homes, has already provided Maintenance Bonds for In-Tract Improvements and Landscape Improvements (Bond No. 00-255-273 for $477,800.00 for In-Tract Improvements and Bond No. 00-255-272-A for $61,332.15 for Landscape Improvements) to cover the twelve-month warranty period for these improvements.
After the acceptance of improvements, the City will then incur costs of $18,000 per year, associated with street sweeping and necessary repairs to streets and utilities. Regular roadway maintenance will be funded by the general fund and sewer and water maintenance will be funded through respective enterprise funds. A Lighting and Assessment Maintenance District (LLD 99-8) has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION IN FEE FOR STREETS RIGHT OF WAY, FOR ALL PARCELS AND EASEMENTS FOR PUBLIC USE AS SHOWN ON THE FINAL MAP, ACCEPTING THE PUBLIC IMPROVEMENTS (WATER, SANITARY SEWER, STORM DRAIN, FIBER OPTICS AND STREETS WITH ALL RELATED IMPROVEMENTS) FOR MAINTENANCE, ACCEPTING THE SUBDIVISION MAINTENANCE BONDS, AND RELEASING THE SUBDIVISION PERFORMANCE AND PAYMENT BONDS FOR SUBDIVISION NO. 7844, PROVIDENCE, SHEA HOMES, LOCATED AT THE SOUTHWEST CORNER OF BALFOUR ROAD AND SELLERS AVENUE
WHEREAS, on February 20, 1996, by Planning Commission Resolution No. 96-04, the Planning Commission approved Tentative Subdivision Map No. 7844, with conditions; and
WHEREAS, on February 9, 1999, the City Council approved Resolution No. 99-52 approving the Final Map of Subdivision No. 7844, accepting the improvement security and approving the Subdivision Improvement Agreement; and
WHEREAS, the required public improvements have been completed and are in conformance with the approved improvement plans.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements (waterlines, sanitary sewer, storm drain, fiber optics and streets with all related improvements) are hereby accepted for maintenance, and the offer of dedications for public use of all the streets and parcels as offered for dedication on the Final Map are hereby accepted.
BE IT FURTHER RESOLVED that the Maintenance Bonds to guarantee against defects in material and workmanship for a period of twelve months are hereby accepted.
BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this resolution.
BE IT FURTHER RESOLVED that the offers of dedication in fee are hereby accepted for rights-of-way of Tradition Way, Guise Way, Heritage Way, Panorama Way, Independence Street, Morningside Street, Gerry Street, Legacy Street and Balfour Road Widening, and that the offers of dedication in fee are hereby accepted for Parcel “B” and “C”, and that the offers of dedication are hereby accepted for all subsurface mineral, water and abutters rights relinquished as shown on the Final Map of Subdivision No. 7844.
BE IT FURTHER RESOLVED that the City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
