RECOMMENDATION
Approve a Resolution accepting the offers of dedication for easements for ingress and egress by emergency vehicles for parcels “A”, “B”, “C”, “D”, “E”, ”F” and “G” (private streets); accepting the offers of dedication for the areas designated as “Storm Drain Easement” or “S.D.E.” for public use for storm, flood and surface water drainage purposes; accepting the offers of dedication for the areas designated as “Public Service Easement” or “P.S.E.” for public use as shown on the Final Map; accepting all subsurface water and abutters rights relinquished on said Final Map and accepting public improvements (water lines, sanitary sewer, storm drain, fiber optics and streets with all related improvements); accepting the Subdivision Maintenance Bond and releasing the Subdivision Improvement Securities for Subdivision No. 8083, Pulte Home Corporation, located south of Balfour Avenue and west of Fairview Avenue.

PREVIOUS ACTION
On December 16, 1997, the Planning Commission approved Planning Commission Resolution No. 97-39, approving Tentative Subdivision Map No. 7940 with conditions.

On February 10, 1998, the City Council approved Resolution No. 98-31, revising certain conditions of approval for Tentative Subdivision Map No. 7940.

On November 9, 1999, the City Council passed Resolution No. 99-222, approving the Final Map and accepting the offers of dedication subject to acceptance of improvements, accepting the improvement security and approving the Subdivision Improvement Agreement.

BACKGROUND
The Final Map is part of the Summerset Active Adult Community and is located south of Balfour Road and west of Fairview Avenue, and was recorded on November 18, 1999, in Book 417 of Maps, at page 14, Contra Costa County Records. The subdivision contains 173 single-family residential lots. In conjunction with the Final Map, the developer provided improvement securities (Performance and Payment Bonds) for these improvements. Following are the major improvement quantities installed: 7,100 L.F. of sanitary sewer lines, 4,300 L.F. of water lines, 4,600 L.F. of storm drain lines, 3,800 L.F. of sidewalk, 9,900 L.F. of curb and gutter, 150,000 S.F. of pavement, 33 streetlights and 330 street trees. A final inspection of these improvements found them to be complete and in conformance with the approved improvement plans.

The parcels were offered for dedication on the Final Map. When the Final Map was approved by the City Council, the offers of dedication were accepted subject to acceptance of improvements. Now that the parcels are improved, the City must accept the improvements in order to obtain rights to the parcels offered on the Final Map. The developer of Subdivision No. 8083, Pulte Home Corporation, has already provided a Maintenance Bond for In-Tract Improvements (Bond No.929270880 for $333,584.70) to cover the twelve-month warranty period for these improvements.

FISCAL IMPACT
After the acceptance of improvements, the City will then incur costs of $8,500.00 per year, associated with street sweeping and necessary repairs to streets and utilities. A Lighting and Assessment Maintenance District (LLD 94-1) has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION FOR ALL PARCELS AND EASEMENTS FOR PUBLIC USE AS SHOWN ON THE FINAL MAP, ACCEPTING THE PUBLIC IMPROVEMENTS (WATER, SANITARY SEWER, STORM DRAIN, FIBER OPTICS AND STREETS WITH ALL RELATED IMPROVEMENTS) FOR MAINTENANCE, ACCEPTING THE SUBDIVISION MAINTENANCE BONDS, AND RELEASING THE SUBDIVISION PERFORMANCE AND PAYMENT BONDS FOR SUBDIVISION NO. 8083, SUMMERSET AT BRENTWOOD COUNTRY CLUB, PULTE HOME CORPORATION, LOCATED SOUTH OF BALFOUR ROAD AND WEST OF FAIRVIEW AVENUE 


WHEREAS, on December 16, 1997, by Planning Commission Resolution No. 97-39, the Planning Commission approved Tentative Subdivision Map No. 7940, with conditions; and

WHEREAS, on February 10, 1998, the City Council approved Resolution No. 99-31 revising certain conditions of approval for Tentative Subdivision Map No. 7940; and

WHEREAS, on November 9, 1999, the City Council passed Resolution No. 99-222, approving the Final Map and accepting the offers of dedication subject to acceptance of improvements, accepting the improvement security and approving the Subdivision Improvement Agreement; and 

WHEREAS, the required public improvements have been completed and are in conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements (water lines, sanitary sewer, storm drain, fiber optics and streets with all related improvements) are hereby accepted for maintenance, and the offer of dedication for public use of all the parcels as offered for dedication on the Final Map are hereby accepted.

BE IT FURTHER RESOLVED that the Maintenance Bonds to guarantee against defects in material and workmanship for a period of twelve months are hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this resolution.

BE IT FURTHER RESOLVED that the offers of dedication for easements for ingress and egress by emergency vehicles for parcels “A”, “B”, “C”, “D”, “E”, ”F” and “G” (private streets) are hereby accepted, and the offers of dedication for the areas designated as “Storm Drain Easement” or “S.D.E.” for public use for storm, flood and surface water drainage purposes are hereby accepted, and that the offers of dedication are hereby accepted for “Public Service Easement” or “P.S.E.” and all subsurface water and abutters rights relinquished as shown on the Final Map of Subdivision No. 8083.

BE IT FURTHER RESOLVED that the City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
