RECOMMENDATION
Approve a Resolution accepting all Balfour-Guthrie Park (Parcel #2) improvements for maintenance as shown on Final Map No. 8323, accepting the Park Maintenance Bond in the amount of $137,096.9 for Subdivision No. 8323, Brookfield Homes, located north of Balfour Road and west of West Country Club Drive.

PREVIOUS ACTION
On March 9, 1993, the Planning Commission approved Planning Commission Resolution No. 93-27, approving Tentative Subdivision Map No. 7705 with conditions.

On May 9, 2000, the City Council approved Resolution No 2070, approving the Final Map of Subdivision No. 8323 with improvement securities and a Subdivision Improvement Agreement.

BACKGROUND
The Final Map containing this park is located north of Balfour Road, and was recorded on June 27, 2000, in Book 421 of Maps, at page 1, Contra Costa County records. The Final Map contains 17 parcels including this park parcel. In conjunction with the Final Map, the developer provided improvement securities (Performance and Payment Bonds) for these park improvements. A final inspection of these improvements found them to be complete and in conformance with the approved improvement plans.

The roadway improvements for this development have not been accepted by the City, and are not ready for acceptance at this time. The Balfour-Guthrie Park property (Parcel #2) has been accepted in fee by the City Council with the Final Map approval on May 9, 2000 Council Meeting. The City is accepting the park improvements at this time, so it may be opened for use to the public. The park contains a light multi-use ball field, basketball courts, tennis court, restrooms, picnic areas, play areas, parking lot, benches and water drinking fountain.

The developer of Subdivision No. 8323, Brookfield Homes, has already provided a Park Maintenance Bond (Bond No. 58598263 for $137,096.90) to cover the twelve-month warranty period for the park improvements.

FISCAL IMPACT
After the acceptance of park improvements, the City will then incur costs in the amount of $64,000.00 per year for landscape maintenance for this 6.43 acre park, and will be funded by Citywide Park Maintenance District 98-1.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING ALL RELATED PARK IMPROVEMENTS FOR MAINTENANCE, ACCEPTING THE PARK MAINTENANCE BONDS FOR PARCEL “2” (BALFOUR-GUTHRIE PARK), SUBDIVISION NO. 8323, BROOKFIELD HOMES, LOCATED NORTH OF BALFOUR ROAD 


WHEREAS, on March 9, 1993, the Planning Commission approved Planning Commission Resolution No. 93-27, approving Tentative Subdivision Map No. 7705 with conditions; and

WHEREAS, on May 9, 2000, the City Council approved Resolution No 2070, approving the Final Map of Subdivision No. 8323 with improvement securities and a Subdivision Improvement Agreement; and

WHEREAS, the required park improvements, have been completed and are in conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the park improvements are hereby accepted for maintenance.

BE IT FURTHER RESOLVED that the Maintenance Bonds to guarantee against defects in material and workmanship for a period of twelve months are hereby accepted.

BE IT FURTHER RESOLVED that the City Clerk is herby directed to file this Resolution with the Recorder of Contra Costa County.
