Subject/Title: Authorize the Mayor or City Manager and City Clerk or any of their designees to execute the necessary Easement Deeds to PG&E for the 60kV Transmission Pole Line relocation along Sunset Road for the Sunset Industrial Complex, CIP Project No. 336-3128.

RECOMMENDATION
Approve a Resolution authorizing the Mayor or City Manager and City Clerk or any of their designees to execute the necessary Easement Deeds to Pacific Gas and Electric Co. (PG&E) for the 60kV Transmission Pole Line relocation along Sunset Road, and any other documents as may be needed to complete the transaction. 

PREVIOUS ACTION
On January 12,1999, by Resolution No. 99-14, the City Council approved the purchase of the 40 acre parcel of land north of Sunset Road, east of Tresch Road, west of Sunset Park, and south of the Wastewater Treatment Plant. The intent of this purchase was for a combination of an industrial complex and expansion of Sunset Park.

On November 28, 2000, by Resolution No. 2204, the City Council directed the City Engineer to hire a consultant to design the necessary plans and maps to facilitate the industrial complex construction, directing the City Engineer to remove portions of the apple orchard with the exception of a screening buffer of trees, directing the City Engineer to bid the project and return to Council for award of the construction contract at the appropriate time, directing the Economic Development Director to initiate an advertising campaign, and if necessary hire a consultant to assist in that effort; and directing the Finance Director to fund these functions to the maximum extent allowable by law through the use of Redevelopment Funds.

On February 13, 2001, the City Council approved the Agreement for Contract Services with Jones & Stokes for the preparation and studies associated with the Environmental Impact Report for the Sunset Industrial Park.

On May 22, 2001, by Resolution No. 2299, the City Council certified and approved the Negative Declaration and adopted the 2001/06 Capital Improvement Program, which included the Sunset Industrial Complex, CIP Project No. 336-3128.

On November 13, 2001, by Resolution No. 2405, the City Council approved a Change Order with Jones & Stokes for additional environmental studies associated with the Environmental Impact Report for Sunset Industrial Complex, CIP Project No. 336-3128.

On June 25,2002, the City Council approved executing an agreement with The Covello Group, Inc. to provide Construction Management Services for the Sunset Industrial Complex, CIP Project No. 336-3128.

On June 25, 2002, by Resolution No. 2589, the City Council approved the extension of the design contract with McGill Martin Self, Inc., to continue with the project through construction for the Sunset Industrial Complex, CIP Project No. 336-3128.

On July 23, 2002, by Resolution No. 2628, the City Council awarded the construction contract for the Sunset Industrial Complex, CIP Project No. 336-3128 to A. Teichert Construction and authorized the City Manager to execute the agreement and any necessary documents. 

BACKGROUND
In conjunction with the Sunset Industrial Complex Project, Sunset Road is being widened. The widening of the road is necessitating the relocation on the existing 60kV wood power poles owned by Pacific Gas and Electric (PG&E) along the proposed project. Per City’s Municipal Code, any overhead power lines up to 21kV are required to be installed underground as properties develop. Since this line is 60kV, this line will stay as overhead and is proposed to be relocated to facilitate road improvements. The 21kV overhead power line on the 60kV pole will be undergrounded as part of the Sunset Industrial Complex improvements. In order for the poles to be relocated the City needs to grant an easement to PG&E. This work must be completed as soon as possible so the roadway construction can begin.

FISCAL IMPACT
Under our Franchise Agreement there is no cost to the City for the relocation of the power poles.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE MAYOR OR CITY MANAGER AND CITY CLERK OR ANY OF THEIR DESIGNEES TO EXECUTE THE NECESSARY EASEMENT DEEDS TO PACIFIC GAS AND ELECTRIC CO. (PG&E) FOR THE 60KV TRANSMISSION POLE LINE RELOCATION ALONG SUNSET ROAD, AND ANY OTHER DOCUMENTS AS MAY BE NEEDED TO COMPLETE THE TRANSACTION.

WHEREAS, Easement Deeds between the City of Brentwood and PG&E are necessary to relocate the 60kV Transmission Pole Line along Sunset Road.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the Mayor or City Manager and City Clerk or any of their designees are authorized to execute the necessary Easement Deeds to PG&E for the 60kV Transmission Pole Line relocation along Sunset Road, and any other documents as may be needed to complete the transaction.
