RECOMMENDATION
Approve a Resolution authorizing the City Manager to execute a Change Order with Harris and Associates in the amount of $108,200 and include 10% contingency for additional services for Brentwood Boulevard Widening, CIP Project No. 336-3054.

PREVIOUS ACTION
On July 25, 2000, the City Council authorized the City Manager to enter into a Professional Services Agreement with Harris and Associates for the design of Brentwood Boulevard Widening, CIP Project No. 336-3054, in the amount of $460,160.63. 

BACKGROUND
On September 24, 2002, the City Council authorized the award of contract to Top Grade Construction, Inc. Staff is now preparing to enter the construction phase of the project, which is funded by state and federal grant money in the amount of $2.2 million. The provisions of the federal and state grants require strict monitoring of labor compliance, quality assurance, inspection procedures and detailed record keeping of construction operations. Any non-compliance with these provisions may jeopardize the City’s eligibility to receive these funds.

In consideration of the current workload, staff does not have the resources available to provide the required level of inspection and quality assurance for this project. Therefore, staff requests approval of the Change Order for additional services for construction inspection and material testing as specified in the attached proposal.
FISCAL IMPACT
The Fiscal Year 2003/07 CIP budget contains funds for Brentwood Boulevard Widening, CIP Project No. 336-3054.

RESOLUTION NO.


A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO EXECUTE A CHANGE ORDER WITH HARRIS AND ASSOCIATES IN THE AMOUNT OF $108,200 AND INCLUDE 10% CONTINGENCY FOR ADDITIONAL SERVICES FOR BRENTWOOD BOULEVARD WIDENING, CIP PROJECT NO. 336-3054.


WHEREAS, on July 25, 2000, the City Council authorized staff to execute a contract with Harris and Associates to design Brentwood Boulevard Widening, CIP Project No. 336-3054; and

WHEREAS, the project went to bid and opened on September 17, 2002; and 

WHEREAS, on September 24, 2002, the City Council awarded a Construction Contract to Top Grade Construction, Inc.; and 

WHEREAS, staff is now preparing to enter into the construction phase of the project, which is funded by state and federal grant money in the amount of $2.2 million; and

WHEREAS, The provisions of the federal and state grants require strict monitoring of labor compliance, quality assurance, inspection procedures and detailed record keeping of construction operations, and any non-compliance with these provisions may jeopardize the City’s eligibility to receive these funds; and

WHEREAS, in consideration of the current workload, staff does not have the resources available to provide the required level of inspection and quality assurance for this project.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood that the City Manager is authorized to execute the Change Order with Harris and Associates in the amount of $108,200 for the Brentwood Boulevard Widening, CIP Project No. 336-3054.

BE IT FURTHER RESOLVED that the City Manager is granted the authority to execute change orders up to 10% of the contract amount.
