Subject/Title: Approve the Purchase Agreement with Liberty Union High School District of Contra Costa County (Community Education Center) for the Brentwood Boulevard Curve, CIP Project No. 336-3100.

RECOMMENDATION
Approve a Resolution approving an agreement for purchase of a fee parcel with Liberty Union High School District, for a portion of real property identified as APN 013-050-009, generally located at Brentwood Boulevard and Second Street, hereby accepting real property on behalf of the City, and authorizing the Mayor or City Manager and City Clerk or any of their designees to execute the agreement, and such other documents as may be needed to complete the transaction including acceptance of the Deed.

PREVIOUS ACTION
On October 12, 1999, the City Council approved the Design Contract with CCS Planning and Engineering Incorporated for the Brentwood Boulevard Curve, CIP Project No. 336-3100.

On February 8, 2000, the City Council authorized the application of Federal Surface Transportation Program funding for Brentwood Boulevard Curve, CIP Project No. 336-3100, and funding was awarded July 28, 2000.

On March 13, 2001, the City Council approved a Consultant Services Agreement with Cordoba Consulting, Inc. to provide necessary project management services for this project.

On June 26, 2001, the City Council approved an extension of time to the Contract between CCS Incorporated and the City of Brentwood for the design of the Brentwood Boulevard Curve, CIP Project No. 336-3100. 

On May 7, 2002, by Resolution No. 02-18, the Planning Commission confirmed that the proposed 2002/03 – 2006/07 Capital Improvement Program (CIP) is consistent with the adopted General Plan of the City of Brentwood as required by Section 6540l of the Government Code.

On May 28, 2002, the City Council adopted the City’s 2002/03 – 2006/07 Capital Improvement Program that included the Brentwood Boulevard Curve, CIP Project No. 336-3100. 

BACKGROUND
The purchase of the Liberty Union High School property is necessary for the reconstruction of the road alignment adjacent to the Safeway Shopping Center. The reconstruction will increase the radius of curve and correct the super elevation of the roadway. These changes are necessary to increase public safety. 

FISCAL IMPACT
The City has received two separate grants totaling $920,000, which will fund the acquisition of this property through the CIP project.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING A RESOLUTION APPROVING AN AGREEMENT FOR PURCHASE OF A FEE PARCEL WITH LIBERTY UNION HIGH SCHOOL DISTRICT, FOR A PORTION OF REAL PROPERTY IDENTIFIED AS APN 013-050-009, GENERALLY LOCATED AT BRENTWOOD BOULEVARD AND SECOND STREET, HEREBY ACCEPTING REAL PROPERTY ON BEHALF OF THE CITY, AND AUTHORIZING THE MAYOR OR CITY MANAGER AND CITY CLERK OR ANY OF THEIR DESIGNEES TO EXECUTE THE AGREEMENT, AND SUCH OTHER DOCUMENTS AS MAY BE NEEDED TO COMPLETE THE TRANSACTION INCLUDING ACCEPTANCE OF THE DEED.

WHEREAS, on May 7, 2002, by Resolution No. 02-18, the Planning Commission confirmed that the proposed 2002/03 – 2006/07 Capital Improvement Program (CIP) is consistent with the adopted General Plan of the City of Brentwood as required by Section 65401 of the Government Code; and

WHEREAS, on May 28, 2002, the City Council adopted the City’s 2002/03 – 2006/07 Capital Improvement Program that included the Brentwood Boulevard Curve, CIP Project No. 336-3100; and

WHEREAS, a portion of real property identified as APN 013-050-009, generally located at Brentwood Boulevard and Second Street in the City of Brentwood, is needed for the Brentwood Boulevard Curve, CIP Project No. 336-3100; and

WHEREAS, a Purchase Agreement between the City of Brentwood and the vested property owner has been developed and is necessary to transfer property.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood, that the Purchase Agreement in the amount of $4,800.00 is hereby approved.

BE IT FURTHER RESOLVED that the Mayor or City Manager and City Clerk or any of their designees are authorized to execute the agreement and any related escrow documents including acceptance of the Grant Deed.

BE IT FURTHER RESOLVED that the City of Brentwood hereby accepts the Grant Deed.
