Approve a Resolution authorizing the City Manager to award a construction contract to AA1 Services, Inc. for the Zone 1 Water Reservoir Coating Project, CIP Project No. 562-5602; to execute the agreement and necessary documents in the amount of $335,000; and to execute change orders up to 10% of the total contract amount.

The four reservoirs in the City have a combined capacity of 10.8 million gallons. The reservoirs are above-grade, welded steel. These reservoirs provide equalization, emergency supply, and fire water supply to the community. This particular water reservoir was built in 1996. No additional protective coating has been applied. The exterior surface is beginning to rust through and interior inspection shows roof and sidewall coating failure. The recoating will add to the life expectancy of the reservoir as well as reduce taste, odor and color complaints.
This project includes furnishing all labor, materials, equipment, performing all work necessary and incidentals to the construction of the project known as Zone 1 Water Reservoir-Coating, CIP No. 562-5602, according to drawings and specifications as prepared by the City of Brentwood and according to the contract documents. Work will be performed on a 2.5 million gallon nominal capacity welded steel water storage tank and includes the removal of all interior coatings, and repainting the reservoir interior shell, ladder, overflow, roof drain piping and other miscellaneous steel with an epoxy based coating. The work to be performed also includes the removal of existing exterior roof coating and repainting the reservoir exterior shell, ladder, piping and other miscellaneous steel with an epoxy based coating.
Project is to be completed within 60 calendar days from the date specified in the Notice to Proceed. The contractor shall pay to the City of Brentwood the sum of $2,000 for each and every calendar day past the projected completion date or past the City approved extensions.

The projected fiscal impact for this project is $335,000, which is funded through the CIP project No. 562-5602.

APPROVE A RESOLUTION AUTHORIZING THE CITY MANAGER TO AWARD A CONSTRUCTION CONTRACT TO AA1 SERVICES, INC. FOR THE ZONE 1 WATER RESERVOIR COATING PROJECT, CIP PROJECT NO. 562-5602; TO EXECUTE THE AGREEMENT AND NECESSARY DOCUMENTS IN THE AMOUNT OF $335,000; AND TO EXECUTE CHANGE ORDERS UP TO 10% OF THE TOTAL CONTRACT AMOUNT.
WHEREAS, the exterior surface is beginning to rust through and the interior coating shows roof and sidewall coating failure; and
WHEREAS, the bid opening for said project was held September 24, 2002 and AA1 Services, Inc. was determined to have provided the lowest, responsible base bid of $335,000 for the Zone 1 Water Reservoir Coating Project, CIP Project No. 562-5602, which is the basis for awarding the contract.
NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood shall award the Construction Contract to AA1 Services, Inc. in the amount of $335,000 for the Zone 1 Reservoir Coating Project, CIP Project No. 562-5602.
BE IT FURTHER RESOLVED that the City Manager is granted the authority to execute the agreement and change orders up to 10% of the contract amount.

ZONE 1 WATER RESERVOIR-COATING
PROJECT NO. 562-5602
THIS AGREEMENT FOR CONSTRUCTION is made and entered into this _____ day of September, 2002, by and between the City of Brentwood (herein called City) and AA1 Services, Inc., a California corporation, a partnership or an individual (circle one) located at _________________________, herein called Contractor.
The City and the Contractor agree as follows:
(1) CONTRACT SUM: The City agrees to pay, and the Contractor agrees to accept, in full payment for constructing the Project in strict accordance with the Contract Documents and performing all other requirements of the Contract Documents, the sum of three hundred and thirty-five thousand dollars ($335,000) to be paid in accordance with the Contract Documents.
(2) COMPLIANCE WITH LAW: The City is a public agency. All provisions of law applicable to public contracts are a part of this contract to the same extent as though set forth herein and will be complied with by the Contractor.
(3) CONTRACT DOCUMENTS: The following Contract Documents relating to this Agreement are hereby made a part of and incorporated by reference into this Agreement: The Notice Inviting Bids, Invitation to Bid, Information for Bidders, Contract Proposal, Faithful Performance Bond, Labor and Materials Payment Bond, Contractor’s Certificate Regarding Worker’s Compensation, Certificate of Insurance and Endorsement (Worker’s Compensation), Certificate of Insurance and Endorsement (General Liability), General Conditions, Special Provisions, Plans and Specifications, CalTrans Standard Plans and Specifications, City of Brentwood Standard Plans and Specifications, Plans, and supplemental agreements, certifications, and endorsements applicable to this work, with all modifications incorporated in said documents prior to receipt of the Contract Proposals. Any work called for in one Contract Document not mentioned in another is to be performed and executed the same as if mentioned in all Contract Documents.
Contractors are required by law to be licensed and regulated by the Contractor’s State License Board, which has jurisdiction to investigate complaints against contractors if a complaint is filed within three years of the date of the alleged violation. Any questions concerning a contractor may be referred to the Registrar, Contractors’ State License Board, P.O. Box 26000, Sacramento, California 95826.
This Agreement is executed by the City upon approval by the City Council at their regular scheduled meeting of October 8, 2002, and the Contractor has caused this Agreement to be duly executed.
