Subject/Title: Closure of Certain Streets to Facilitate Sweeney’s Station 4 Second Annual Firemen’s Fundraiser Benefit on October 19, 2002

RECOMMENDATION Adoption of Resolution authorizing the temporary closure of certain streets and temporarily establishing no parking restrictions and tow away zones in order to facilitate Sweeney’s Station 4 Second Annual Firemen’s Fundraiser Benefit for International Firefighters Association Local 1230.
PREVIOUS ACTION In November of 2001 the City Council approved the street closure.
BACKGROUND Sweeney’s Station 4 is requesting a street closure on October 19, 2002 between 11:00 a.m. and 10:00 p.m. in order to facilitate a fundraiser for the local firefighters. The funds raised will be kept locally and are to benefit the families of fallen firefighters or firefighters otherwise in need.
Fiscal impact on the City is estimated to be $1115. In the event that the City Council elects to fund all or part of the total cost, those funds can be charged to the Police Department’s Special Events account as approved in the 02/03 fiscal year budget.

RESOLUTION NO. 02-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE TEMPORARY CLOSURE OF CERTAIN STREETS AND TEMPORARILY ESTABLISHING NO PARKING RESTRICTIONS AND TOW AWAY ZONES IN ORDER TO FACILITATE THE SECOND ANNUAL CONTRA COSTA COUNTY FIREMEN’S FUNDRAISER BENEFIT FOR LOCAL 1230.
WHEREAS, Sweeney’s Station 4 will be holding a fundraiser on October 19, 2002 between the hours of 11:00 a.m. and 10:00 p.m.; and
WHEREAS, to accommodate the fundraiser, Sweeney’s Station 4 has requested the temporary closure of the following street as follows:
* First Street from the north curb line of Oak Street to the driveway of East Diablo Fire Station #54 between the hours of 11:00 a.m. and 10:00 p.m.
WHEREAS, pursuant to Vehicle Code Section 21101(e), the City may temporarily close portions of streets for parades and local special events such as the Brentwood Arts Commission fundraiser when the closing is necessary for the safety and protection of persons who are to use those portions of the street during the temporary closure; pursuant to Vehicle Code 22507, the City may prohibit parking on portions of streets during all or certain hours of the day; pursuant to Vehicle Code Section 22651(b), (m), and (n), the City peace officers may remove by towing any vehicle from those portions of the street where parking is prohibited.
NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood that the Police Department is ordered to close the above mentioned street, prohibit parking and establish a tow away zone between the hours of 11:00 a.m. and 10:00 p.m. for the fundraiser on October 19, 2002
