Subject/Title: Temporary Use Permit for Auto Tent Sale on Private Property

RECOMMENDATION 
That Council provide direction to staff as to whether the Temporary Use for an Auto Tent Sale on Private Property is acceptable.

PREVIOUS ACTION
This request for a Temporary Use Permit (TUP) is directly related to the preceding item on the Council Agenda related to direction on provisions for regulating temporary retail sales. The Council previously directed staff to bring an Ordinance back to Council regulating temporary uses. The previous application by this same company was denied by the Council because the tent sale was planned on Public Property.

BACKGROUND
As of the writing of this report, Tracy Chevrolet/Dawoe was to have filed an application for a TUP, but it has not yet been received. Staff did receive a written request from Steve Kraut saying that he wanted to have a tent sale and that it would be held at the U.S. Print property which is private property and satisfies the concerns at the Council at the previous hearing on this issue. It does not follow the direction that staff received from the Economic Development Council Subcommittee.

Depending on the action taken by Council on the preceding agenda item, and if the applicant still wishes to proceed, it would be appropriate for Council to review this request and determine whether it should be allowed and then direct the Community Development Director how to proceed. 

FISCAL IMPACT
Unknown at this time. A portion of the sales tax revenues from the sale of used cars to Brentwood residents will come to the City of Brentwood.
