RECOMMENDATION
Approve a Resolution authorizing the City Manager to execute a Contract with Pacific Gas and Electric (PG&E) in an amount not to exceed $403,823.29 for the undergrounding of the existing 21 kV Overhead Distribution Power Line along Lone Tree Way Between Jeffrey Way and Fairview Avenue and approve change orders up to 15% of the contract amount for CIP Project No. 336-3127.

PREVIOUS ACTION
On May 22, 2001, the City Council approved Resolution No. 2299 adopting the City’s 2001/2006 Capital Improvement Program that includes the Lone Tree Way Widening Project.

On February 12, 2002, the City Council approved a Design, Engineering and Estimating Contract with Pacific Gas and Electric (PG&E) for the undergrounding of the existing 21 kV Overhead Distribution Power Line along Lone Tree Way Between Jeffrey Way and Fairview Avenue for CIP 
Project No. 336-3127.

BACKGROUND
The attached contract is for Pacific Gas and Electric (PG&E) to underground the existing 21 kV Overhead Distribution Power Line along Lone Tree Way Between Jeffrey Way and Fairview Avenue. This relocation is necessitated by the construction of the Lone Tree Way Widening. These improvements will improve the aesthetics of the area by removing the overhead power lines and placing the facility underground in a joint trench with other utilities (Pacific Bell, AT&T, fiber optics, etc.). Once this Agreement is approved by Council then PG&E can commence with all necessary work and inspections for installing a new joint trench along the south side of Lone Tree Way.

FISCAL IMPACT
The funds for this work are through developer funding, assessment district funds and facility fees, which are included in the existing budget as approved in this year’s Capital Improvement Program 2001/2006. The City of Antioch will pay their fair share of the joint trench costs from Jeffrey Way to Empire Avenue.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH PACIFIC GAS AND ELECTRIC (PG&E) IN AN AMOUNT NOT TO EXCEED $403,823.29 FOR THE UNDERGROUNDING OF THE EXISTING 21 kV OVERHEAD DISTRIBUTION POWER LINE ALONG LONE TREE WAY BETWEEN JEFFREY WAY AND FAIRVIEW AVENUE FOR CIP PROJECT NO. 336-3127.


WHEREAS, On May 22, 2001, the City Council approved Resolution No. 2299 adopting the City’s 2001/2006 Capital Improvement Program that includes the Lone Tree Way Widening Project; and

WHEREAS, On February 12, 2002, the City Council approved a Design, Engineering and Estimating Contract with Pacific Gas and Electric (PG&E) for the undergrounding of the existing 21 kV Overhead Distribution Power Line along Lone Tree Way Between Jeffrey Way and Fairview Avenue for CIP Project No. 336-3127; and

WHEREAS, the undergrounding of the 21 kV Overhead Distribution Power Line by Pacific Gas and Electric is part of the Lone Tree Way Widening project as shown on the improvement plans.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brentwood hereby authorizes the City Manager to execute a Contract with Pacific Gas and Electric for the undergrounding of the existing 21 kV Overhead Distribution Power Line for the Lone Tree Way Widening Project, CIP Project No. 336-3127, in an amount not to exceed $403,823.29 and further authorizes the City Manager to approve change orders up to 15% of the contract amount.
