Subject/Title: Approval of Amended Final Map and Acceptance of Public Improvements
for Brentwood Park, Pulte Homes Subdivision No. 8226

Approve a Resolution approving the Amended Final Map No. 8226 and accepting the offers of dedication in fee for the right-of-ways of Atherton Boulevard, Atherton Court, Atherton Place, Begonia Drive, Begonia Court, Maplewood Court, Dahlia Court, Dahlia Drive, Evergreen Court, Falcon Court, Gardenside Court, Hawthorn Court, Hawthorn Drive, Iris Court, Ascot Court, Ascot Place, Dover Court and O’Hara Avenue Widening; accepting the offers of dedication for the area designated as “Public Utility Easement” or “P.U.E.” for public use as shown on the Final Map; accepting all relinquished abutter’s rights and all interest in subsurface mineral and water rights as offered on the Final Map; accepting public improvements (water lines, sanitary sewer, storm drain, fiber optics and streets with all related public improvements) for maintenance; accepting the Subdivision Maintenance Bond and releasing the Subdivision Improvement Securities for Brentwood Park, Pulte Homes, Subdivision No. 8226, located north of Lone Tree Way and east of O’Hara Avenue.
On November 16, 1999, the Planning Commission approved Planning Commission Resolution No. 99-48, approving Tentative Subdivision Map No. 8226 with conditions.
On November 28, 2000, the City Council approved Resolution No. 2201, approving the Final Map of Subdivision No. 8226 with improvement securities and a Subdivision Improvement Agreement.
Parcels “A”, “B”, “C” and “F were accepted in fee with Final Map No. 8226 approved on November 28, 2000 at the City Council Meeting by Resolution No. 2201.
The Final Map is located north of Lone Tree Way and east of O’Hara Avenue, and was recorded on December 18, 2000, in Book 427 of Maps, at page 1, Contra Costa County records. The subdivision contains 137 single-family residential lots. This Final Map had numerous corrections that needed to be made and in order to satisfy these corrections the Amended Final Map have been made and need to be approved concurrently with the acceptance of the public improvements. In conjunction with the Final Map and Amended Final Map, the developer provided improvement securities (Performance and Payment Bonds) for these improvements. A final inspection of these improvements found them to be complete and in conformance with the approved improvement plans.
The parcels were offered for dedication on the Final Map and Amended Final Map. When the Final Map was approved by the City Council, the offers of dedication were accepted subject to acceptance of improvements. Now that the public improvements have been constructed, Staff recommends the City Council approve the Amended Final Map and accept the public improvements in order to obtain the rights to the parcels offered on the Amended Final Map. The developer of Subdivision No. 8226, Brentwood Park, Pulte Homes, has already provided a Maintenance Bond for In-Tract Improvements (Bond No. 929244723 for $1,234,500.00) to cover the twelve-month warranty period for these improvements.
After the acceptance of the public improvements, the City will then incur costs of $6,500.00 per year, associated with street sweeping and necessary repairs to streets and utilities. Roadway maintenance costs will be paid from the City’s general fund and utility maintenance costs through respective enterprise utility funds. A Lighting and Assessment Maintenance District (LLD 00-04) has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING THE AMENDED FINAL MAP AND ACCEPTING THE OFFERS OF DEDICATION IN FEE FOR STREETS RIGHT OF WAY, FOR ALL PARCELS AND EASEMENTS FOR PUBLIC USE AS SHOWN ON THE FINAL MAP, ACCEPTING THE PUBLIC IMPROVEMENTS (WATER, SANITARY SEWER, STORM DRAIN, FIBER OPTICS AND STREETS WITH ALL RELATED PUBLIC IMPROVEMENTS) FOR MAINTENANCE, ACCEPTING THE SUBDIVISION MAINTENANCE BONDS, AND AUTHORIZING RELEASING THE SUBDIVISION PERFORMANCE AND PAYMENT BONDS FOR BRENTWOOD PARK, PULTE HOMES, SUBDIVISION NO. 8226, LOCATED NORTH OF LONE TREE WAY AND EAST OF O’HARA AVENUE
WHEREAS, on November 16, 1999, by Planning Commission Resolution No. 99-48, the Planning Commission approved Tentative Subdivision Map No. 8226, with conditions; and
WHEREAS, on November 28, 2000, the City Council approved Resolution No. 2201 approving the Final Map of Subdivision No. 8226, accepting the improvement security, and approving the Subdivision Improvement Agreement; and
WHEREAS, on November 28, 2000, the City Council approved Resolution No. 2201 accepting Parcels A, B, C, and F in fee with approval of this Final Map of Subdivision No. 8226; and
WHEREAS, the amendment of the 8226 Final Map has been prepared for approval, and
WHEREAS, the required public improvements, have been completed in conformance with the approved improvement plans.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements (water lines, sanitary sewer, storm drain, fiber optics and streets with all related public improvements) are hereby accepted for maintenance, and the offers of dedication for public use of all the streets and parcels as offered for dedication on the Final Map are hereby accepted.
BE IT FURTHER RESOLVED that the Maintenance Bonds to guarantee against defects in material and workmanship for a period of twelve months are hereby accepted.
BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this resolution.
BE IT FURTHER RESOLVED that the Amended 8226 Final Map is hereby approved and the offers of dedication in fee are hereby accepted for right-of-ways of Atherton Boulevard, Atherton Court, Atherton Place, Begonia Drive, Begonia Court, Maplewood Court, Dahlia Court, Dahlia Drive, Evergreen Court, Falcon Court, Gardenside Court, Hawthorn Court, Hawthorn Drive, Iris Court, Ascot Court, Ascot Place, Dover Court and O’Hara Avenue Widening, and that the offers of dedication are hereby accepted for “Public Utility Easements” and for relinquished interest in subsurface mineral and water rights below 300 feet as shown on the Final Map of Subdivision No. 8226.
BE IT FURTHER RESOLVED that the City Clerk is herby directed to file this Resolution with the Recorder of Contra Costa County.
