RECOMMENDATION
Approve a Resolution authorizing the City Manager to execute a Request for Proposal for the formal renewal process of AT&T Broadband‘s cable television license agreement and request the City Clerk to issue said Request for Proposal to AT&T Broadband.

PREVIOUS ACTION
On July 23, 2002, the City Council held a Public Hearing for Public Ascertainment and Community Needs Assessment Related to Reviewing the Cable Television Franchise held by AT&T Broadband.

On March 12, 2002, the City Council held a Public Hearing for Public Ascertainment and Community Needs Assessment Related to Reviewing the Cable Television Franchise held by AT&T Broadband.

On May 14, 2002, the City Council approved and waived the first reading of Ordinance No. 705 Amending Chapter 5.24 of the Brentwood Municipal Code pertaining to Cable Television Ordinance. 

BACKGROUND
Currently the City of Brentwood is under the formal renewal process regarding AT&T’s cable franchise, which expires on September 30, 2003. Pursuant to the federal Cable Act (47 U.S.C. sec. 546) and the Brentwood Municipal Code, Chapter 5.24.090, the next step after completion of the public ascertainment is for the City to issue a Request for Proposal for the formal renewal process of AT&T Broadband‘s cable television license agreement.

RESOLUTION NO. 


A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO EXECUTE A REQUEST FOR PROPOSAL FOR THE FORMAL RENEWAL PROCESS OF AT&T BROADBAND’S CABLE TELEVISION LICENSE AGREEMENT AND REQUEST THE CITY CLERK TO ISSUE SAID REQUEST FOR PROPOSAL.

WHEREAS, currently the City of Brentwood is under the formal renewal process regarding AT&T’s cable television franchise which expires on September 30, 2003; and 

WHEREAS, on July 23, 2002, the City Council held a Public Hearing for Public Ascertainment and Community Needs Assessment Related to Reviewing the Cable Television Franchise held by AT&T Broadband; and 

WHEREAS, pursuant to the federal Cable Act (47 U.S.C. sec. 546) and the Brentwood Municipal Code, Chapter 5.24.090, the next step after completion of the public ascertainment is for the City to issue a Request for Proposal for the formal renewal process of AT&T Broadband‘s cable television license agreement.

NOW, THEREFORE, BE IT RESOLVED to authorize the City Manager to execute a Request for Proposal for the formal renewal process of AT&T Broadband‘s cable television license agreement.

BE IT FURTHER RESOLVED to request the City Clerk to issue said Request for Proposal to AT&T Broadband.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 27th day of August 2002, by the following vote:

REQUEST FOR PROPOSAL

The City of Brentwood hereby issues to AT&T Broadband a request for proposal for renewal of its cable television franchise granted pursuant to Resolutions 2408 and 2421, effective October 1, 2001. The City issues this request pursuant to the renewal provisions of the federal Cable Act (47 U.S.C. sec. 546) and the Brentwood Municipal Code, Section 5.24.090.

The proposal should address all of the requirements of the Brentwood Municipal Code. In particular, pursuant to Municipal Code sec. 5.24.090 (c), the City requests that the applicant submit:

1. copies of any and all reports made to the City or to the FCC pertaining to the cable system during the franchise term and any records, documents or information pertaining thereto;
2. commitments that the applicant will supply services sufficient to meet future cable-related needs and interests of the City of Brentwood, including the specific plans for doing so; and
3. copies of any and all records, documents and information pertaining to whether the applicant has satisfactorily performed its obligations under its franchise.
The applicant should submit one (1) original and ten (10) copies of its proposal not later than close of business on Monday, October 28, 2002 to:
