Pulte Homes, Subdivision No. 8147

RECOMMENDATION
Approve a Resolution accepting the offer of dedication for Parcel “A”, Laurelwood Estates Unit 3, Subdivision No. 8147, for public use as shown on the Final Map, and accepting park improvements for maintenance, accepting the Maintenance Bond in the amount of $158,578.00 by Pulte Homes, located in SPA ”L”, east of Fairview Avenue and south of Grant Street. 

PREVIOUS ACTION
On June 3, 1997, by Resolution No. 97-21, the Planning Commission approved Tentative Subdivision Map No. 8033, with conditions.

On May 25, 1999, by Resolution No 99-123, the City Council approved the Final Map of Subdivision No. 8147, with improvement securities and Subdivision Improvement Agreement.

On September 25, 2001, by Resolution No. 2369, the City Council accepted the offers of dedication and public improvements for maintenance (excluding Parcel “A”) for Subdivision No. 8147.

BACKGROUND
The Final Map is located in SPA ”L”, east of Fairview Avenue and south of Grant Street, and was recorded on June 1, 1999, in Book 411 of Maps, at page 1, Contra Costa County Records. The subdivision contains 22 single-family residential lots and a 0.35-acre park. In conjunction with the Final Map, the Developer provided Performance and Payment Bonds for these improvements. A final inspection of these improvements found them to be completed and in conformance with the improvement plans.

The parcels were offered for dedications on the Final Map. When the Final Map was approved by the City Council the offers of dedications were accepted subject to acceptance of improvements. Now that the parcels are improved, the City must accept the improvements in order to obtain rights to the parcels offered on the Final Map. The Developer of Subdivision No. 8147, Pulte Homes, has already provided a Maintenance Bond (Bond No. 5947866-0001 in the amount of $158,578.00) to cover the twelve-month warranty period for these improvements. The City is accepting the park at this time, so it may be opened for use to the public.

FISCAL IMPACT
After the acceptance of park improvements, the City will then incur costs in the amount of $3,500 per year for landscape maintenance, and will be funded by Citywide Park Maintenance District 98-1.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION FOR PARCEL “A” FOR PUBLIC USE AS SHOWN ON THE FINAL MAP, ACCEPTING PUBLIC IMPROVEMENTS FOR MAINTENANCE, ACCEPTING THE PARK MAINTENANCE BOND FOR LAURELWOOD ESTATES UNIT 3, PULTE HOMES, SUBDIVISION NO. 8147, LOCATED IN SPA ”L”, EAST OF FAIRVIEW AVENUE AND SOUTH OF GRANT STREET.

WHEREAS, on June 3, 1997, by Resolution No. 97-21, the Planning Commission approved Tentative Subdivision Map No. 8033, with conditions; and

WHEREAS, on May 25, 1999, by Resolution No. 99-123, the City Council approved the Final Map of Subdivision No. 8147, Pulte Homes, accepting the offers of dedication shown thereon subject to acceptance of improvements, accepting the improvement security and approving the Subdivision Improvement Agreement; and

WHEREAS, on September 25, 2001, by Resolution No. 2369, the City Council accepted the offers of dedication and public improvements (excluding Parcel “A”) for maintenance for Subdivision No. 8147; and 

WHEREAS, the required public improvements have been completed and are in conformance with approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements are hereby accepted for maintenance, and the dedications for public use as shown on the Final Map are hereby accepted.

BE IT FURTHER RESOLVED that the Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.

BE IT FURTHER RESOLVED that the offers of dedication are hereby accepted for Parcel “A” as shown on the Final Map of Subdivision No. 8147.

BE IT FURTHER RESOLVED that the City Clerk is hereby directed to file this Resolution with the Recorder of Contra Costa County.
