Subject/Title: Approve a Purchase and Sale Agreement with East Contra Costa Irrigation District (ECCID) for parcels north of Sunset Road

RECOMMENDATION
Approve a Resolution approving an agreement for purchase of fee parcels with East Contra Costa Irrigation District (ECCID), for real property identified as APN 018-200-003, 018-200-004, 018-200-005, 018-210-001 and 018-210-002, generally located on the north side of Sunset Road and adjacent to Sunset Industrial Complex Project, CIP Project No. 336-3128, Sunset Park Master Plan and Expansion Project, CIP Project No. 522-5201, and the Solid Waste Transfer Station Improvements Project, CIP Project No. 542-5401, hereby accepting real property on behalf of the City, and authorizing the Mayor or City Manager and City Clerk or any of their designees to execute the agreement, and such other documents as may be needed to complete the transaction including acceptance of the Deed.

PREVIOUS ACTION
On January 12,1999, by Resolution No. 99-14, the City Council approved the purchase of the 40 acre parcel of land north of Sunset Road, east of Tresch Road, west of Sunset Park, and south of the Wastewater Treatment Plant. The intent of this purchase was for a combination of an industrial complex and expansion of Sunset Park.

On November 28, 2000, by Resolution No. 2204, the City Council directed the City Engineer to hire a consultant to design the necessary plans and maps to facilitate the industrial complex construction, directing the City Engineer to remove portions of the apple orchard with the exception of a screening buffer of trees, directing the City Engineer to bid the project and return to Council for award of the construction contract at the appropriate time, directing the Economic Development Director to initiate an advertising campaign, and if necessary hire a consultant to assist in that effort; and directing the Finance Director to fund these functions to the maximum extent allowable by law through the use of Redevelopment Funds.

On February 13, 2001, the City Council approved the Agreement for Contract Services with Jones & Stokes for the preparation and studies associated with the Environmental Impact Report for the Sunset Industrial Park.

On April 24, 2001, the City Council authorized the City Manager to enter into an agreement with Abey/Arnold Associates, Landscape Architects to provide Park Master Planning Services for the 37 acre Sunset Sports Complex, CIP Project No. 522-5201.

On May 22, 2001, by Resolution No. 2299, the City Council certified and approved the Negative Declaration and adopted the 2001/2006 Capital Improvement Program, which included the Sunset Park Master Plan and Expansion Project, CIP Project No. 522-5201, Sunset Industrial Complex Project, CIP Project No. 336-3128, and Solid Waste Transfer Station Improvements Project, CIP Project No. 542-5401.

On April 23, 2002, by Resolution No. 2526, the City Council authorized the City Manager to execute an agreement with Maximus, Inc. for the Public Works Department Master Plan and relocation of the Maintenance Facility currently located at 161 Sycamore Avenue. The proposed site for the Maintenance Facility is located on City owned property on Sunset Road and identified as APN 018-230-030. Cost for this work is not to exceed $61,080. Completion of the Master Plan should be 120 days from the date of contract approval.

BACKGROUND
The purchase of parcel APN 018-200-003 will add .43 acres to the Sunset Industrial Complex Project, CIP Project No. 336-3128, and will allow for a more efficient design to maximize the use of the land being developed for the industrial park. This project will increase the industrial land available in the City, locate industrial users adjacent to other compatible land uses, upgrade Brentwood Boulevard streetscape by removing industrial users, and increase the tax base for the City.

The purchase of parcels APN 018-200-005 and 018-210-002 will add 1.62 acres to the Sunset Park Master Plan and Expansion Project, CIP Project No. 522-5201. This project is listed as a priority in the Parks and Recreation Master Plan as a community sport facility and the addition of this acreage will allow for a more efficient design to maximize the use of the land being developed as a sports complex.

The purchase of parcels APN 018-200-004 and 018-210-001 will add 1.56 acres to the Solid Waste Transfer Station Improvements Project, CIP Project No. 542-5401. The facility improvements planned include a scale house, scale, litter containment, structure covers, maintenance shop and similar improvements. These improvements are required to allow public access and remain in compliance with California Integrated Waste Management Board permit requirements. The addition of this acreage to the overall development plan will enable the City to expand the necessary facilities in a manner that maximizes the efficiency and efforts of the transfer station and maintenance facilities.

FISCAL IMPACT
Funding for these five parcels would be through the CIP Projects as follows:

Sunset Park Master Plan and Expansion Project, CIP Project No. 522-5201 $21,027.00
Solid Waste Transfer Station Improvements Project, CIP Project No. 542-5401 $20,243.00

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AN AGREEMENT FOR PURCHASE OF FEE PARCELS WITH EAST CONTRA COSTA IRRIGATION DISTRICT (ECCID), FOR REAL PROPERTY IDENTIFIED AS APN 018-200-003, 018-200-004, 018-200-005, 018-210-001 AND 018-210-002, GENERALLY LOCATED ON THE NORTH SIDE OF SUNSET ROAD AND ADJACENT TO SUNSET INDUSTRIAL COMPLEX PROJECT, CIP PROJECT NO. 336-3128, SUNSET PARK MASTER PLAN AND EXPANSION PROJECT, CIP PROJECT NO. 522-5201, AND THE SOLID WASTE TRANSFER STATION IMPROVEMENTS PROJECT, CIP PROJECT NO. 542-5401, HEREBY ACCEPTING REAL PROPERTY ON BEHALF OF THE CITY, AND AUTHORIZING THE MAYOR OR CITY MANAGER AND CITY CLERK OR ANY OF THEIR DESIGNEES TO EXECUTE THE AGREEMENT, AND SUCH OTHER DOCUMENTS AS MAY BE NEEDED TO COMPLETE THE TRANSACTION INCLUDING ACCEPTANCE OF THE DEED.

WHEREAS, a Purchase Agreement between the City of Brentwood and the vested property owner has been developed and is necessary to transfer property.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood, that the Purchase Agreement is hereby approved.

BE IT FURTHER RESOLVED that the Mayor or City Manager and City Clerk or any of their designees are authorized to execute the agreement and any related escrow documents including acceptance of the Grant Deed.

BE IT FURTHER RESOLVED that the City of Brentwood hereby accepts the Grant Deed.
