Subject/Title: Rejection of all bids to construct the Sunset Industrial Complex, CIP Project 336-3128.

RECOMMENDATION
Reject all bids received for construction of the Sunset Industrial Complex, CIP Project 336-3128, proceed to re-advertise the project for bid, and return to Council for award of the construction contract.

PREVIOUS ACTION
On November 28, 2000, the City Council authorized staff to execute a contract with McGill Martin Self, Inc. to design the Sunset Industrial Complex.

On May 28, 2002, the City Council Approved the 2002/07 Capital Improvement Program which includes the Sunset Industrial Complex as a part of the program.

On June 25, 2002, the City Council approved the Construction Management Services agreement between The Covello Group Inc. and the City of Brentwood for the Sunset Industrial Complex.

On June 25, 2002, the City Council approved the extension of the design contract with McGill Martin Self, Inc., to continue with the project through construction.

BACKGROUND
The City advertised the project for construction beginning Tuesday, May 21, 2002, and bids were opened on June 26, 2002. A total of five bids were received. During the proposal review process, staff determined that some of the bids had irregularities. These irregularities could cause delay of the construction of Sunset Industrial Complex indefinitely. In order to continue with the project’s construction during the summer of 2002, staff recommends the rejection of all bids and Council’s authorization to re-bid the project. 

The bids received are as follows:
1. A. Teichert & Sons, Inc. $3,209,577.55
2. DeSilva Gates $3,648,642.00
3. McGuire & Hester $3,799,598.80
4. Top Grade Construction $3,465,488.45
5. William McCullough Co. $3,778,685.95

FISCAL IMPACT
There is no change to the funding for the project.
