Subject/Title: Approve a Resolution authorizing the Mayor and City Staff to execute the First Amendment to the Joint Powers Agreement, between the State Route 4 Bypass Authority and the City of Brentwood to include the Lone Tree Way Improvements.

RECOMMENDATION
Approve a Resolution authorizing the Mayor and City Staff to execute the First Amendment to the Joint Powers Agreement, between the State Route 4 Bypass Authority and the City of Brentwood to include the Lone Tree Way Improvements.

PREVIOUS ACTION:
On May 11, 1999, City Council approved the Agreement with the State Route 4 Bypass Authority and the City of Brentwood for construction of Sand Creek Road (Route 4 to Fairview Avenue) and the relocation of a major waterline. 

BACKGROUND
The City of Brentwood and the State Route 4 Bypass Authority (SR4BA) have been working together for several years to implement the construction of Segment 2 of the State Route 4 Bypass. The efforts came to fruition this past spring with the opening of Segment 2 from Lone Tree Way to Balfour Road. SR4BA and the City of Brentwood entered into a Joint Exercise of Powers Agreement (JEPA) to provide for the construction of the Sand Creek Road (Bypass to Fairview Avenue) and the relocation of a major waterline all in conjunction with the construction of the Segment 2 project.

Over the last year, City Staff has had numerous meetings with staff from SR4BA, City of Antioch and surrounding developers to coordinate and expedite the construction of Lone Tree Way widening (Heidorn Ranch Road to Jeffrey Way). By approving this First Amendment to the Agreement (attached), the additional improvements to Lone Tree Way will be constructed to its ultimate configuration. This construction is imperative for retail/commercial development along the Lone Tree Way corridor and is in conformance with the approved General Plan. 

FISCAL IMPACT
Funding for the Amendment will derive from Developer’s participation and Development Fees including roadway and utility fees and assessments. Arcadia Development will pay for their frontage improvement cost and City will fund the portion east of the Arcadia Development to Jeffrey Way.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE MAYOR AND CITY STAFF TO EXECUTE THE FIRST AMENDMENT TO THE JOINT POWERS AGREEMENT BETWEEN THE STATE ROUTE 4 BYPASS AUTHORITY AND THE CITY OF BRENTWOOD TO INCLUDE THE LONE TREE WAY IMPROVEMENTS.


WHEREAS, on May 11, 1999, the City Council approved the Agreement with the State Route 4 Bypass Authority to construct Sand Creek Road (Bypass to Fairview Avenue) and the relocation of a major waterline; and

WHEREAS, The City of Brentwood and the Bypass Authority have been working together for several years to implement the construction of Segment 2; and

WHEREAS, the Segment 2 portion of the State Route 4 opened in April of this year; and

WHEREAS, to continue with the improvements involving the Segment 2 portion of the Bypass, the ultimate configuration of Lone Tree Way is beneficial to the City of Brentwood; and

WHEREAS, the construction will enable the needed commercial development to progress down the Lone Tree Way corridor.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby authorize the Mayor and City Staff to execute the First Amendment to the Joint Powers Agreement between the State Route 4 Bypass Authority and the City of Brentwood.
