Subject/Title: Acceptance of Park Improvements for Brentwood Villages, Grupe Company, Subdivision No. 8411

RECOMMENDATION
Approve a Resolution accepting the offers of dedication in fee for parcel “I” for public use as shown on the Final Map and accepting all park improvements for maintenance, accepting the Park Maintenance Bond in the amount of $80,346.90 and releasing the Park Improvement Securities for Brentwood Villages, Grupe Company, Subdivision No. 8411, located south of Balfour Road and east of Walnut Boulevard.

PREVIOUS ACTION
On May 19, 1992, the Planning Commission approved Planning Commission Resolution No. 92-23, approving Tentative Subdivision Map No. 7736 with conditions.

On September 12, 2000, the City Council approved Resolution No 2147, approving the Final Map of Subdivision No. 8411 with improvement securities and a Subdivision Improvement Agreement.

BACKGROUND
The Final Map is located south of Balfour Road and east of Walnut Boulevard, and was recorded on September 26, 2000, in Book 424 of Maps, at page 30, Contra Costa County records. The subdivision contains 175 single-family residential lots and a 5-acre park. In conjunction with the Final Map, the developer provided improvement securities (Performance and Payment Bonds) for these improvements. A final inspection of these improvements found them to be complete and in conformance with the approved improvement plans.

The parcels were offered for dedication on the Final Map. When the Final Map was approved by the City Council, the offers of dedication were accepted subject to acceptance of improvements. Now that the parcels are improved, the City must accept the improvements in order to obtain rights to the parcels offered on the Final Map. The developer of Subdivision No. 8411, Grupe Company, has already provided a Park Maintenance Bond (Bond No. 3SM 984 600 00-A for $ 80,346.90) to cover the twelve-month warranty period for the park improvements.

The roadway improvements for this development have not been accepted by the City, and are not ready for acceptance at this time. The City is accepting the park at this time, so it may be opened for use to the public.

FISCAL IMPACT
After the acceptance of park improvements, the City will then incur costs in the amount of $50,000 per year for landscape maintenance, and will be funded by Citywide Park Maintenance District 98-1.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION IN FEE FOR PARCEL “I” FOR PUBLIC USE AS SHOWN ON THE FINAL MAP, ACCEPTING ALL RELATED PARK IMPROVEMENTS FOR MAINTENANCE, ACCEPTING THE PARK MAINTENANCE BONDS, AND RELEASING THE PARK PERFORMANCE AND PAYMENT BONDS FOR BRENTWOOD VILLAGES, GRUPE COMPANY, SUBDIVISION NO. 8411, LOCATED SOUTH OF BALFOUR ROAD AND EAST OF WALNUT BOULEVARD


WHEREAS, on May 19, 1992, the Planning Commission approved Planning Commission Resolution No. 92-23, approving Tentative Subdivision Map No. 7736 with conditions; and

WHEREAS, on September 12, 2000, the City Council approved Resolution No 2147, approving the Final Map of Subdivision No. 8411 with improvement securities and a Subdivision Improvement Agreement; and

WHEREAS, the required park improvements, have been completed and are in conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the park improvements are hereby accepted for maintenance, and the offers of dedication for public use of parcel “I” as offered for dedication on the Final Map are hereby accepted.

BE IT FURTHER RESOLVED that the Maintenance Bonds to guarantee against defects in material and workmanship for a period of twelve months are hereby accepted.

BE IT FURTHER RESOLVED that the Park Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.

BE IT FURTHER RESOLVED that the offer of dedication in fee are hereby accepted for Parcel “I” as shown on the Final Map of Subdivision No. 8411.

BE IT FURTHER RESOLVED that the City Clerk is herby directed to file this Resolution with the Recorder of Contra Costa County.
