Subject/Title: Acceptance of Improvements for “Campanello 2,” Centex Homes, Subdivision No. 8608

RECOMMENDATION
Approve a Resolution accepting the offers of dedication in fee for right-of-way of Quiet Gable Court, accepting the offers of dedication in fee for the areas designated as parcel “A” and parcel “B”, accepting the offers of dedication for the areas designated as “Public Utility Easements” or “P.U.E.” for public use as shown on the Final Map; accepting all relinquished interest in subsurface mineral and water rights below 300 feet as shown on said Final Map and accepting public improvements (water lines, sanitary sewer, storm drain, fiber optics and streets with all related improvements) for maintenance; accepting the Subdivision Maintenance Bond and the Landscape Bond in the amount of $3,000 Cash for lots #8 and #9 (the front yard landscaping will be done at a later date) and releasing the Subdivision Improvement Securities for Subdivision No. 8608, “Campanello 2, Centex Homes, located south of Balfour Road and east of Marsh Creek.

PREVIOUS ACTION
On February 15, 2000, the Planning Commission approved Planning Commission Resolution No. 00-09, approving Tentative Subdivision Map No. 8371 with conditions.

On February 15, 2001, the City Council approved Resolution No 2234, approving the Final Map of Subdivision No. 8371 with improvement securities and a Subdivision Improvement Agreement.

On December 11, 2001, the City Council approved Resolution No. 2422, approving the Final Map of Subdivision No. 8608 with improvement securities and a Subdivision Improvement Agreement. This Final Map is a re-subdivision of Subdivision No. 8371, and the Subdivision Improvement Agreement supersedes the 8371 Subdivision Improvement Agreement.

BACKGROUND
The Final Map is located south of Balfour Road and east of Marsh Creek, and was recorded on December 26, 2001, in Book 438 of Maps, at page 1, Contra Costa County records. The subdivision contains 9 single-family residential lots. In conjunction with the Final Map, the developer provided improvement securities (Performance and Payment Bonds) for these improvements. A final inspection of these improvements found them to be complete and in conformance with the approved improvement plans.

The parcels were offered for dedication on the Final Map. When the Final map was approved by the City Council, the offers of dedication were accepted subject to acceptance of improvements. Now that the parcels are improved, the City must accept the improvements in order to obtain rights to the parcels offered on the Final Map. The developer of Subdivision No. 8608, Centex Homes, has previously provided a Maintenance Bond (Bond No. 607-4487-1 for $ 25,557.00) to cover the twelve-month warranty period for these improvements.

FISCAL IMPACT
After the acceptance of improvements, the City will then incur costs in the amount of $500 per year, associated with street sweeping and necessary repairs to streets and/or utilities. Roadway maintenance costs will be paid from the City’s general fund and utility maintenance costs through respective enterprise utility funds. A Landscape and Lighting and Maintenance District (LLD 95-2) has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION IN FEE FOR STREETS RIGHT OF WAY, FOR ALL PARCELS AND EASEMENTS FOR PUBLIC USE AS SHOWN ON THE FINAL MAP, ACCEPTING THE PUBLIC IMPROVEMENTS (WATER, SANITARY SEWER, STORM DRAIN, FIBER OPTICS AND STREETS WITH ALL RELATED IMPROVEMENTS) FOR MAINTENANCE, ACCEPTING THE SUBDIVISION MAINTENANCE BONDS, AND RELEASING THE SUBDIVISION PERFORMANCE AND PAYMENT BONDS FOR SUBDIVISION NO. 8608, “CAMPANELLO 2”, CENTEX HOMES, LOCATED SOUTH OF BALFOUR ROAD AND EAST OF MARSH CREEK

WHEREAS, on February 15, 2000, the Planning Commission approved Planning Commission Resolution No. 00-09, approving Tentative Subdivision Map No. 8371 with conditions; and

WHEREAS, on February 15, 2001, the City Council approved Resolution No 2234, approving the Final Map of Subdivision No. 8371 with improvement securities and a Subdivision Improvement Agreement; and

WHEREAS, on December 11, 2001, the City Council approved Resolution No. 2422, approving the Final Map of Subdivision No. 8608 with improvement securities and a Subdivision Improvement Agreement. This Final Map is a re-subdivision of Subdivision No. 8371 and the Subdivision Improvement Agreement supersedes the 8371 Subdivision Improvement Agreement; and

WHEREAS, the required public improvements have been completed and are in conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements (water lines, sanitary sewer, storm drain, fiber optics and streets with all related improvements) are hereby accepted for maintenance, and the offer of dedications for public use of all the streets and parcels as offered for dedication on the Final Map are hereby accepted.

BE IT FURTHER RESOLVED that the Maintenance Bonds to guarantee against defects in material and workmanship for a period of twelve months are hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this resolution.

BE IT FURTHER RESOLVED that the offers of dedication in fee are hereby accepted for right-of-way of Quiet Gable Court and parcel “A” and parcel “B” and that the offers of dedication are hereby accepted for all “Public Utility Easements” and for relinquished interest in subsurface mineral and water rights below 300 feet as shown on the Final Map of Subdivision No. 8608.

BE IT FURTHER RESOLVED that the City Clerk is herby directed to file this Resolution with the Recorder of Contra Costa County.
