RECOMMENDATION
Approve a Resolution accepting the offers of dedication for Parcel A, Trail Improvements, for public use as shown on the Final Map for maintenance; accepting the Trail Maintenance Bond and releasing the Performance and Payment Bonds for the Trail in Subdivision No. 8178, Lyon Grove, William Lyon Homes, located in SPA L on the east side of Minnesota Avenue and south of Sand Creek.

PREVIOUS ACTION
On June 3, 1997, the Planning Commission approved Planning Commission Resolution No. 97-21, approving Tentative Subdivision Map No. 8033, with conditions.

On August 25, 1998, the City Council approved Resolution No. 98-148, approving the Final Map of Subdivision No. 8178 with improvement securities and a Subdivision Improvement Agreement.

On March 28, 2000, the City Council approved Resolution No. 2043, accepting the offers of dedication of street right-of-way, accepting the public improvements for maintenance, accepting the performance and payment bonds for the Trail Improvements and releasing associated performance and payment bonds for Subdivision No. 8178.

BACKGROUND
The Final Map is located in SPA L on the east side of Minnesota Avenue and south of Sand Creek, and was recorded on September 10, 1998, in Book 402 of Maps, at page 45, Contra Costa County Records. The Subdivision contains 122 single-family residential lots. In conjunction with the Final Map, the developer provided improvement securities (Performance and Payment Bonds) for these improvements. A final inspection of these improvements (excluding Trail Improvements) found them to be complete and in conformance with the approved improvement plans and were accepted at the March 28, 2000 City Council Meeting.

At the same time, the City received a separate performance and payment bonds for Parcel A, Trail Improvements that had not been completed at that time. Now, the final inspection of the Trail Improvements found them to be complete and in conformance with approved improvement plans.

Parcel A was offered for dedication on the Final Map. When the Final Map was approved by the City Council, the offers of dedication were accepted subject to acceptance of improvements. Now that Parcel A is improved, the City must accept the improvements in order to obtain rights to Parcel A offered on the Final Map. The developer of Subdivision No. 8178, Lyon Grove, William Lyon Homes, has provided a Maintenance Bond for Trail Improvements (Bond No. 3SM98208100-A for $10,413.45) to cover the twelve-month warranty period for these improvements.

FISCAL IMPACT
After the acceptance of improvements, the City will then incur costs of $350 per year. A Lighting and Assessment Maintenance District (LLD 99-3) has been formed for this Subdivision and will be responsible for the street lighting and landscape maintenance.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION FOR PARCEL A, TRAIL IMPROVEMENTS, FOR PUBLIC USE AS SHOWN ON THE FINAL MAP, ACCEPTING THE PUBLIC IMPROVEMENTS FOR MAINTENANCE, ACCEPTING THE TRAIL MAINTENANCE BONDS, AND RELEASING THE TRAIL PERFORMANCE AND PAYMENT BONDS FOR SUBDIVISION NO. 8178, LYON GROVE, WILLIAM LYON HOMES, LOCATED IN SPA L, ON THE EAST SIDE OF MINNESOTA AVENUE AND NORTH OF SAND CREEK 


WHEREAS, on June 3, 1997, by Planning Commission Resolution No. 97-21, the Planning Commission approved Tentative Subdivision Map No. 8033, with conditions; and

WHEREAS, on August 25, 1998, the City Council approved Resolution No. 98-148, approving the Final Map of Subdivision No. 8178, accepting the improvement security and approving the Subdivision Improvement Agreement; and

WHEREAS, on March 28, 2000, the City Council approved Resolution No. 2043, accepting the offers of dedication of street right-of-way shown thereon, accepting the public improvements for maintenance, accepting the performance and payment bonds for the Trail Improvements and releasing the associated securities for Subdivision No. 8178; and 

WHEREAS, the required public improvements in Parcel A, Trail Improvements, have been completed and are in conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements are hereby accepted for maintenance, and the offer of dedications for public use of Parcel A as offered for dedication on the Final Map are hereby accepted.

BE IT FURTHER RESOLVED that the Maintenance Bonds to guarantee against defects in material and workmanship for a period of twelve months are hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this resolution.

BE IT FURTHER RESOLVED that the offer of dedication is hereby accepted for Parcel A, as shown on the Final Map of Subdivision No. 8178.

BE IT FURTHER RESOLVED that the City Clerk is herby directed to file this Resolution with the Recorder of Contra Costa County.
