RECOMMENDATION
Approve a resolution authorizing the City Manager to enter into agreement of purchase and sale of Brentwood Union School District for $225,000 for purchase of 5 acres for a neighborhood park.

PREVIOUS ACTION
Empire Avenue Elementary School/Park is an approved project in the 2001/2006 City of Brentwood Capital Improvement Program as approved by City Council on May 22, 2001.

BACKGROUND
The Brentwood Union School District bought 18+ acres for a future elementary school/park site in 2000. It was anticipated that 5 acres of the site would be purchased by the City to develop a neighborhood park adjacent to the school. As the School District is moving forward with design and development of the site, the School District is offering the 5 acres to the City at the original price per acre that they purchased the property.

The purchase of the property for $225,000 is budgeted as a part of the 2001/2006 CIP program. The City Attorney has reviewed and approved the agreement. Staff is recommending approval to move forward and purchase the property.


FISCAL IMPACT
$225,000 to be paid out of the approved CIP project for Empire Avenue Elementary School/Park.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO ENTER INTO AGREEMENT OF PURCHASE AND SALE OF BRENTWOOD UNION SCHOOL DISTRICT FOR $225,000 FOR PURCHASE OF 5 ACRES FOR A NEIGHBORHOOD PARK.

WHEREAS, the City of Brentwood has a history of agreements with the Brentwood Union School District; and

WHEREAS, the Empire Avenue Elementary School/Park has been approved in the 2001/2006 Capital Improvement Program; and

WHEREAS, the School District is moving forward with design and development of the site and is offering the 5 acres to the City at the original price per acre that they purchased the property.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood hereby authorizes the City Manager to enter into agreement of purchase and sale of Brentwood Union School District for $225,000 for purchase of 5 acres for a neighborhood park.
