Subject/Title: Reconsideration of Motion Granting the Appeal of Design Review 01-32, Lone Tree Center

Submitted by: Dennis Beougher, City Attorney

Approved by: John Stevenson, City Manager

There is no staff recommendation unless the City Council agrees to grant the Mayor’s request to reconsider the motion granting the appeal of Design Review 01-32, Lone Tree Center. If the City Council approves the motion to reconsider, staff recommends that a time be set for a public hearing to hear the issues related to the design review of this project.

At the April 9, 2002 meeting, Mayor McPoland, Councilmember Petrovich, and Councilmember Gomes voted to grant the appeal of Design Review No. 01-32, Lone Tree Center, without prejudice to bring the project back at any time provided that project applicant supplied information concerning air quality, traffic, and presented documents to the satisfaction of city staff that cross easements would be granted between the Albers Parcel and the project parcel.

The City Council previously approved Meeting Rules and Procedures . One of the rules, Rule 25. permits a motion to reconsider any action approved by council shall be made by a member of the majority no later than the end of the next public meeting of the Council. Such motion shall be debatable.

The Mayor asked the City Attorney to place the reconsideration motion to reconsider the above referenced motion on the city’s agenda for debate and action.
