RECOMMENDATION
Approve a Resolution awarding the construction contract for a portion of Brentwood Boulevard/Lone Tree Way Wastewater, CIP Project No. 592-5910, to Talus Construction, Inc, authorize the Executive Director to execute the agreement and necessary documents in the amount of $146,587.00 and grant the Executive Director the authority to execute change orders up to 20% of the contract amount.

PREVIOUS ACTION
On May 22, 2001, the City Council approved Resolution No. 2299 adopting the 2001/2006 Capital Improvement Program including Brentwood Boulevard/Lone Tree Way Wastewater, CIP Project No. CIP 592-5910, for sewer improvements in the north Brentwood area.

On August 28, 2001, the City Council authorized the City Engineer to proceed with design of option C to make sanitary sewer service available for a portion of Brentwood Boulevard south of Lone Tree Way, proceed to bid the sanitary sewer improvements project (a portion of Brentwood Boulevard/Lone Tree Way Wastewater, CIP Project No. 592-5910) and return to Council with award of the construction contract.

On March 12, 2002, the City Council rejected all bids received for construction of a portion of Brentwood Boulevard/Lone Tree Way Wastewater, CIP Project No. 592-5910, and authorized staff to proceed to re-advertise the project for bid and return to Council for award of the construction contract.

BACKGROUND
At the first bid opening for this project March 7, 2002, the three valid bids received were more than fifty percent (50%) over the project’s cost estimate. The City re-advertised the project for construction bids beginning Monday, March 18, 2002, and the new bids were opened on March 29, 2002 with a total of four valid bids received. The bids were reviewed and the apparent lowest responsive responsible bidder was Talus Construction, Inc. in the amount of $146,587.00

The four bids were:

1. Talus Construction, Inc. $146,587.00
2. D. R. Lemmings Construction Co. $147,944.00
3. Mozingo Construction Co. $180,390.25
4. William G. McCullough $184,908.00

FISCAL IMPACT
The 2001/2006 CIP Budget contains construction funds for this current phase of the project with 25% of the funds allocated from the Redevelopment North Brentwood Non-Housing Fund and 75% allocated from the Redevelopment Housing Set-Aside Fund. Approximate maintenance costs for the 500 LF of sewer line being installed will be $700.00 annually.

A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF BRENTWOOD AWARDING THE CONSTRUCTION CONTRACT TO TALUS CONSTRUCTION, INC. IN THE AMOUNT OF $146,587.00 FOR A PORTION OF THE BRENTWOOD BOULEVARD/LONE TREE WAY WASTEWATER PROJECT, CIP PROJECT NO. 592-5910, AND AUTHORIZING THE EXECUTIVE DIRECTOR TO EXECUTE CHANGE ORDERS UP TO 20% OF THE CONTRACT AMOUNT 


WHEREAS, on May 22, 2001, the City Council approved Resolution 2299, adopting the 2001/2006 Capital Improvement Program, including the Brentwood Boulevard/Lone Tree Way Wastewater Project, CIP Project No. 592-5910, for sewer improvements in the North Brentwood Redevelopment Project Area (“Public Improvements”). 

WHEREAS, on August 28, 2001, the City Engineer was authorized to proceed with design of Option C to make sanitary sewer service available for a portion of Brentwood Boulevard south of Lone Tree Way, to proceed to bid the sanitary sewer improvements project (a portion of Brentwood Boulevard/Lone Tree Way Wastewater Project, CIP Project No. 592-5910), and to return with award of the construction contract.

WHEREAS, on March 12, 2002, all construction bids for the Public Improvements were rejected, and staff was directed to re-advertise the project for bid and return for award of the construction contract. 

WHEREAS, on March 18, 2002, the Public Improvements were re-advertised, bids were submitted on March 29, 2002, and City Engineer found the bid process to be in conformance with City standards. 

NOW, THEREFORE, be it resolved by the Redevelopment Agency of the City of Brentwood as follows:

1. The Agency hereby finds and determines as follows:

a. The Public Improvements will be of benefit to the Redevelopment Project Area. This finding is based on the fact that the Public Improvements will be located within the Project Area and will provide wastewater improvements to properties with aged and failing septic systems within the Project Area. 

b. There is no other reasonable means of financing the Public Improvements. This finding is based on the lack of sufficient funds in the capital improvement budget of the City to fund the Public Improvements together with other urgently needed public improvements and facilities and the infeasibility of financing the Public Improvements through an assessment district, community facilities district or other conventional method of financing public facilities. 

c. The payment of funds for the Public Improvements will assist in the elimination of one or more blighting conditions inside the Project, will upgrade existing aged and deteriorated infrastructure systems, will improve existing housing conditions and is consistent with the Implementation Plan. This finding is based on the following facts:

(1) The Implementation Plan identifies as objectives for the five-year period from Fiscal Year 1999/00 through Fiscal Year 2003/04 were the following:

Provide needed public improvements: revitalize the redevelopment project areas through installation of public improvements, including streets, curbs, gutters, sidewalks, utility undergrounding, landscaping, sewer, water and storm drain systems, and bring area infrastructure into compliance with all Federal and State laws.

BE IT FURTHER RESOLVED, by the Redevelopment Agency of the City of Brentwood that the construction contract for a portion of the Brentwood Boulevard Wastewater Project, CIP No. 592-5910, be awarded to Talus Construction, Inc. in the amount of $146,587.00, and authorize the Executive Director to execute change orders up to 20% of the contract amount.
