RECOMMENDATION
Approve a Resolution authorizing the City Manager to increasing the project budget to a total of $544,275, approve a Change Order up to 10% of the contract amount, and amend CIP budget to conform to these amendments for John Muir Parkway, CIP Project No. 336-3121, north of Balfour Road.

PREVIOUS ACTION
On April 11, 2000, the City Council amended the 1999-2004 Capital Improvement Program to include the roadway improvements on John Muir Parkway, CIP Project No. 336-3121.

On November 28, 2000, the City Council approved an amendment to the Subdivision Improvement Agreement with SunCal Corporation for Subdivision No. 8310 to include construction of John Muir Parkway adjacent to Fire Station #52, CIP Project No. 336-3109.

BACKGROUND
The CIP sheet prepared to add this project to the 1999-2004 Capital Improvement Program reflected a total budget amount of $233,285. The construction portion of this budget was shown as $159,000 and was based on the roadway construction costs reflected in the Developer Fee Program. Signal improvements were not included in the original scope of the project.

The Subdivision Improvement Agreement with SunCal Corporation for Subdivision No. 8310 was amended to include provisions to reimburse the developer for actual construction costs for the roadway improvements on John Muir Parkway adjacent to Fire Station #52, 50% of the actual construction costs of the traffic signal at John Muir Parkway and Balfour Road and a 10% overhead and profit for project management.

The developer provided copies of executed contracts for the above scope of work approximately three (3) weeks ago. The total construction costs for the roadway improvements and one-half of the traffic signal installation totals $450,745. The total project cost totals $544,275, as shown on the attached amended budget sheet for CIP Project No. 336-3121.

FISCAL IMPACT
The City will recover approximately 50% of these costs when property owners adjacent to this roadway pay their proportionate share through a Benefit Assessment District, through conditions of approval on planning applications or a combination thereof. The City will recover the remaining project costs through roadway facility fees.

RESOLUTION NO. 


A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD INCREASING THE PROJECT BUDGET FOR JOHN MUIR PARKWAY, CIP PROJECT NO. 336-3121, NORTH OF BALFOUR ROAD, TO A TOTAL OF $544,275, AUTHORIZING THE CITY MANAGER TO APPROVE CHANGE ORDERS UP TO 10% OF THE CONTRACT AMOUNT AND AMENDING THE CIP BUDGET TO CONFORM TO THESE AMENDMENTS. 

WHEREAS, on April 11, 2000, the City Council amended the 1999-2004 Capital Improvement Program to include the roadway improvements on John Muir Parkway, CIP Project No. 336-3121; and

WHEREAS, on November 28, 2000, the City Council approved an amendment to the Subdivision Improvement Agreement with SunCal Corporation for Subdivision No. 8310 to include construction of John Muir Parkway adjacent to Fire Station #52, CIP Project No. 336-3109; and

WHEREAS, the amended Subdivision Improvement Agreement for Subdivision No. 8310 provides for reimbursement of actual costs plus 10% project administration fee; and

WHEREAS, the developer has submitted executed contracts for the roadway and signal improvements on John Muir Parkway north of Balfour Road; and

WHEREAS, the executed construction contracts for the roadway and signal improvements on John Muir Parkway north of Balfour Road increases the total budget to $544,275 for CIP Project No. 336-3121.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brentwood hereby increases the CIP budget for John Muir Parkway, CIP Project No. 336-3121, to $544,275 and authorizes the City Manager to approve change orders up to 10% of the contract amount.

BE IT FURTHER RESOLVED that the Capital Improvement Program budget shall be amended to reflect these changes.
