RECOMMENDATION
Approve a resolution for expenditures to start the Community Facilities District (Fire) and amend the 2001/2002 fire budget to the amount of approximately $184,000, an increase of $84,000.

BACKGROUND
The intent of this Community Facilities District is to pay for the additional (3rd) firefighters at the Brentwood Fire Departments, plus paramedics. CFD # 2 will be placed on all new homes in Brentwood and will pay for additional firefighters, paramedics and the maintenance of open space. CFD # 1 will be placed on a mail-in ballot this summer for all residents to pay for the increased fire service and paramedic services. If CFD # 1 passes, then those portions of CFD # 2 will sunset. The remaining open space maintenance portion of CFD # 2 will continue in effect.

In accordance with the provisions of Section 53312.7 and 53345.8 of the California Government Code, the City of Brentwood previously adopted the Local Goals and Policies and Appraisal Standards. It is proposed to establish a community facilities district within the City under the terms of Chapter 2.5 of Division 2 of Title 5 of the California Government Code, commencing with Section 53311.

Staff is requesting approval for a budget increase to start the Community Facilities District to cover the following expenditures:

Legal – Orrick Herrington $50,000
Engineering – Francisco & Associates $80,000 
County balloting $34,000
Printing & miscellaneous expenses $20,000

FISCAL IMPACT
Expenditures of $100,000 are accounted for in the fire budget for the year 2001/2002, therefore an amendment is needed to increase this budget by $84,000.

RESOLUTION AUTHORIZING THE CITY MANAGER TO APPROVE EXPENDITURES TO START THE COMMUNITY FACILITIES DISTRICT (FIRE) AND AMEND THE FIRE BUDGET TO THE AMOUNT OF APPROXIMATELY $184,000. 

WHEREAS, it is proposed to establish a Community Facilities District within the City under the terms of Chapter 2.5 of Division 2 of Title 5 of the California Government Code, commencing with Section 53311.
WHEREAS, in order to start the Community Facilities District, certain contracts are required for legal and engineering services that will increase the 2001/2002 fire budget by $84,000.
NOW, THEREFORE, BE IT RESOLVED by the City of Brentwood as follows:
Section 1. The 2001/2002 Fire Budget will be amended and increased to $184,000 to start the Community Facilities District.
